Violations Reported at 94% of Nursing Homes
About 17 percent of nursing homes had deficiencies that caused “actual harm or immediate jeopardy” to patients, said the report, by Daniel R. Levinson, the inspector general of the Department of Health and Human Services.
Problems included infected bedsores, medication mix-ups, poor nutrition and abuse and neglect of patients.
Inspectors received 37,150 complaints about conditions in nursing homes last year, and they substantiated 39 percent of them, the report said. About one-fifth of the complaints verified by federal and state authorities involved the abuse or neglect of patients.
About two-thirds of nursing homes are owned by for-profit companies, while 27 percent are owned by nonprofit organizations and 6 percent by government entities, the report said.
The inspector general said 94 percent of for-profit nursing homes were cited for deficiencies last year, compared with 88 percent of nonprofit homes and 91 percent of government homes.
“For-profit nursing homes had a higher average number of deficiencies than the other types of nursing homes,” Mr. Levinson said. “In 2007, for-profit nursing homes averaged 7.6 deficiencies per home, while not-for-profit and government homes averaged 5.7 and 6.3, respectively.”
On Monday, Mr. Levinson issued a compliance guide that says some nursing homes “have systematically failed to provide staff in sufficient numbers and with appropriate clinical expertise to serve their residents.”

What A Tangled Web We Weave...

On the heels of dozens of arrests of journalists at the DNC and RNC, including WBAI's Amy Goodman and Rogue IMC's own Noah Balloon, a clandestine scenario has been unfolding in Medford, Oregon as the local police attempted to frame and arrest another journalist. In a dramatic attempt to subvert justice, the MPD has created false documents in order to illegally entrap and ensnare.
When I stated in my previous report (
To give a brief history here, when I caught the MPD disappearing documents, I went to Internal Affairs for redress. When I complained to Watch commander Sgt. Sergi that my reports had disappeared, he snarled, "Get over it." I then went to the Communications Advisory Committee for redress. As a result of that televised meeting, the police came out with egg all over their collective faces, and Detective Scott Clauson was assigned to the case. He appeared agreeable to investigate a stalking/harrassment claim, and I began turning over evidence to him, including phone records, emails and names of parties who had been contacted by the stalker, who regularly makes email and/or phone contact with my work associates with the intent of defaming me. I also turned over recordings of the harasser's voicemails. These include sounds of guns being fired into the phone and sounds of someone being tortured or murdered.
In a maneuver equal to the antics of a Harry Houdini, the MPD suddenly resurrected the "missing" dispatch call, stating it was misfiled due to the department misspelling my last name. Sgt. Sergi stated that the dispatch call was "located" when the record was searched by my address. However, on two previous occasions multiple employees of the MPD had searched by my address and no such record was ever found. Caught in the act of disappearing records, the MPD apparently furthered the cover-up of their own illegal activity through yet another illegal act--creating a false record, the dispatch call with a misspelled last name. I have attached the record of the dispatch call. While the scan may be slightly fuzzy, the original clearly shows that my name, misspelled as "Thalen, Janet," is in a different type cast than the rest of the document. This further substantiates my allegations that the document was tampered with, and tampered with in exactly the manner which would have exonerated the police from my original allegations that the document was entirely disappeared by the department.
While Detective Clauson initially appeared to be on the track of investigating the stalking/harassment complaint, he actually had no intent in following through on my criminal complaint. Instead, he took a nearly unprecedented step and provided me with a bogus subpoena for my phone records. The subpoena he handed me on August 23 is not the same subpoena tendered to my phone carrier.This was confirmed by a phone call I made to my carrier last week. For all intents and purposes, Scott Clauson was trying to lull me into a false sense of security while he "moved in for the kill."
I am alleging that this action constitutes a felony on the part of Scott Clauson. The fact that the bogus subpoena bears the stamp of Mark Huddleston, D.A., implicates him also in the alleged crime. Mr. Huddleston did not return phone calls from several members of the media concerning these allegations.
I declare with good faith and clean hands that I do not know what in the world the P.D. is looking for, or if they are merely on a fishing expedition. As a journalist and talk show host, I maintain a phone list of many prominent people, including Cindy Sheehan, Larry Chertoff (cousin to DHS chief Michael Chertoff) and many others. I have no criminal record; however, it appears that the MPD is eager to create one for me. So eager, in fact, that the force is now breaking laws with great abandon in their pursuit of this 5'4", one hundred and thirty pound reporter and political talk show host (Republic Broadcasting Network and KSKQ).
I am plagued with some concerns here, and I must ask the following rhetorical question: How many others are now sitting in jail, prison or ended up dead in custody for similar machinations by "officers of the law?" Here is Chief Randy Schoen's phone number--(541) 774-2200. Give him a call, if you will, and ask him how his employees came to be above the law they are mandated to uphold.
In addition, the attempts by the Mayor and Councilman Bob Strosser to gut the Communications Advisory Committee, discussed in the previous report, seem to be coming to fruition as well. The October session of the CAC has been moved to a room with no television hook-up; therefore, Mayor Wheeler's comments concerning the inadvisability of continuing to televise the CAC meetings appear to have been taken as fiat, and will result in a non-publicized meeting of that committee. Activists and other concerned citizens are urged to contact KSKQ at 482-3999 concerning the possibility of arranging a citizen-journalist based coverage of that event.

Elder Justice Act Update:
The Coalition has learned that S. 1070, the Elder Justice Act, has moved to the point where it is being circulated among Senators to try and get it to the Senate floor under unanimous consent.
The process is called hot lining. If no objection is registered over the coming days, then the bill could be eligible for a Senate vote at any time. We have also included the Congressional Budget Office’s scoring of the bill as an attachment to this email. We will closely monitor the process over the coming days and if we are made aware of any objections, we will ask our Coalition members from that state to help with that Senator. As we write this we cannot confirm, but expect, that S. 1577, The Patient Safety and Abuse Prevention Act of 2007, authored by Senator Kohl, may also be hot lined for separate consideration by the full Senate.

Thousands of "Imprisioned Elders" File Class Action Lawsuit

Thousands of elders are Waking up to find themselves in prison like environment , held against their will.
8,500 thousands elder and disabled Medicaid Recipients are waking up to the ultimate nightmare, being chemically restrained and held against their will in un familiar surroundings away from home, family and everything that's dear to them.
They say the state is illegally forcing them to live in nursing homes when they should be able to exercise their G-d given right to live where they chose .
They have filed a federal lawsuit seeking class-action status on behalf of nearly 8,500 institutionalized Medicaid recipients.
Advocates charge that nursing homes, afraid of losing money, have successfully pressured politicians to make qualifying for community care more difficult. Americans who qualify for Medicaid and get sick or disabled enough to require substantial care typically have little problem gaining admission to a nursing home, but getting badly needed services to stay at home are
is very difficult to say the least , add to that the thousands of elders that are forced into state mandated guardianships/conservatorships that strips them of their civil rights and you are starting to get the picture.
"There's a lot of concern that the nursing home industry is very powerful in many states and has made sure that a lot of Medicaid dollars go to institutional care as opposed to home and community-based care," said Toby Edelman, an attorney at the Center for Medicare Advocacy.
The Florida Agency for Health Care Administration, the Florida Department of Elder Affairs and Gov. Charlie Crist's office — the three defendants — all declined to comment on the litigation. So did the attorney general's office, which is representing the defendants.
The American Health Care Association, which represents about 11,000 nursing homes and long-term care facilities, a majority of them for-profit. Spokeswoman Susan Feeney noted, "You don't want to be there but sometimes for health reasons beyond your control, you have to be."

He could have been like any other journalist Michael Putney the one Dr. Robert Sarhan approached to do a story to help free his mother Yvonne Sarhan from being chemically restrained and isolated and prohibited from seeing her son or he could have been like Journalist Suzanne Boyd whom Bonnie Reiter approached to do story about her mother Corinne Bramson who was forced into guardianship , stripped of her rights lost over $250,000.00 in legal fees and was put into a Hospice program under a false diagnosis and allegedly killing her in 12 days with morphine.
Charles Todd Lee like any other Journalist could have easily dismissed the problem as it did not concerned him and waved off the suffering of the victim and of their families by failing to come to their help by publicizing their plight.
The 67-year-old photographer has been confined to a nursing home for five years, the victim of a stroke that paralyzed his left side. And he's angry.
"Most of the people come here to die, so you want to die," he said. "It is a prison. I can't escape it."
Whether the litigation gets Lee and others moved out of nursing homes remains to be seen. But at the very least, it has illuminated the frustration experienced by older people or those with disabilities who say they're shuttled into nursing homes when they are healthy enough to live at home, with relatives, or in other less institutional settings.
John Boyd, 50, has been in a nursing home for the last nine years. He hates them. He became a quadriplegic 36 years ago when he fell off a wall and broke his neck.
"I can't choose what meal I want, I can't have a visitor after 8 o'clock — it's just like a prison without bars," he said.
"People are making decisions for and about me that don't even know me or even care about me. All they care about is the money they're getting for me."

Financial Crisis Deepens

We are in historically unprecedented times. The foundation is being laid for a default of USTreasurys in the wake of the greatest regulatory failure in modern history, and the collapse of the US financial system. Anyone who cannot see that suffers from poor vision, chronic nostalgia, low mental wattage, a paycheck from Wall Street, a post in financial press media, or owning an Economics advanced degree. So many changes come with each passing day, not week, that it boggles the mind.
The runs on US banks are in progress. See Washington Mutual, where private email messages have been shared by WaMu bank officers. WaMu alone could deplete the entire Federal Deposit Insurance Corp fund for bank deposit coverage. Eventually the FDIC will compete for USGovt federal money for bailouts and nationalizations. Eventually, bank deposits will not receive 100 cents per dollar, in a compromise. Next the bank runs will push banks into failure, at a time when stock accounts are under raids, without broad public knowledge.
PREPARE IN THE VERY NEAR FUTURE FOR GOLD TO RISE OVER $100 ON SUCCESSIVE DAYS, AND FOR SILVER TO RISE OVER $2 ON SUCCESSIVE DAYS. Inflation is soon to be seen as the remedy to prevent monetary collapse. Gold just hit 900, and silver has reached 12.70 today. The euro has risen 500 basis points just since Friday morning. Gold is not rising sharply due to inflation concerns alone, although plenty of monetary inflation is set to continue flying through the money pipelines. THE REAL REASON WHY GOLD IS RISING IS FOR THREAT OF SYSTEMIC FINANCIAL FAILURE CENTERING IN THE UNTIED STATES.
What factors are key to gold rising? Perhaps because the US financial system is imploding. Perhaps because the USGovt nationalization demands are accelerating. Perhaps because the threat of default for USTreasurys is seen as inevitable, even imminent. Perhaps because nitwits who have highjacked the White House and USMilitary are planning something truly reckless on the military front in Iran. Perhaps because the US Federal Reserve is depleted and secretly insolvent, even as they put word out of an INFINITE BALANCE SHEET. Perhaps because enormous demand has come in physical gold & silver, despite the low price set by corrupt US PaperHangers. Perhaps because fear has entered the room globally.
As simple citizens, people should be concerned that the US Federal Reserve and US Dept of Treasury have begun to take actions far outside their own legal powers. The bailout of AIG was made illegally. The USFed cannot act to aid non-bank entities. Senator Jim Bunning has drafted Congressional legislation to limit the USFed action outside the banking realm. The system is losing control, especially with the law.
The parade of doomed deals continues. Talks have begun for JPMorgan taking over Washington Mutual. Could the JPMorgan ‘Garbage Can’ be inadequate soon? Bank of America has entered talks to take over Merrill Lynch, apparently striking a deal. Could BOA serve as the alternative ‘Garbage Can’ next, whose service would be as squire to JPMorgan? Now Morgan Stanley is in talks to take over Wachovia. The disaster du jour today seems to be State Street, which was down over 50%. The dominos are falling. THE MESSAGE IS CLEAR: THE DEAD ARE MARRYING THE DEAD. It is unclear what music to play at such events. My suggestion is something from “Phantom of the Opera” would be apt.
The US bankers have lost control badly. Even ill-equipped USFed Chairman Bernanke admitted recently as having lost control. He spoke to economist David Hale at a Florida financial conference last week. Bernanke said, “We have lost control. We cannot stabilize the dollar. We cannot control commodity prices.” The age of central bank control, ala Soviet Politburo, is coming to an end.
Even Morgan Stanley has been forced to close down its trading desks at the Platts Window, where they trade crude oil. The USCongress is equally lost. Today, a quote came from Senate Majority Leader Harry Reid. They are unlikely to pass new legislation to overhaul financial regulations this year. He said, “No one knows what to do. We are in new territory, this is a different game. [Neither Federal Reserve Chairman Ben Bernanke nor Treasury Secretary Henry Paulson] know what to do, but they are trying to come up with ideas.” Gee! Maybe the chief architects of this grand failure have a solution? They should be ignored then imprisoned. Perhaps they are seeking final opportunities to steal, raid, and pilfer from the public till during the final months of this Administration.

Our Neighboor Was Setting Us Up!

As a great many of you are aware , Clara G. Fernandez Social Security Income has been High jacked since July 8th,. 2007.
In spite of there being absolutely NO indication that her family or caregivers have EVER misused her income, it has been diverted and is now being used to pay for attorney fees under the Guise (sic) of protecting her.
Before the forced confiscation of her social security income, we were barely able to meet expenses , now without, Clara is living below the poverty level, with many luxuries like dinner out or ice cream by the beach - OUT OF REACH-
The bottom line that what could be considered Clara's final days are spent a living hell, from hearing to hearing while we are doing everything we can to free Clara and re gain her civil rights while the guardian fights to remain as long as possible and to bill as much as could possibly be imagined at the incapacitated elder's expense.
Everything takes money, in an effort to survive we had attempted to rent out "Mother In Law Quarters" or efficiency apt that we had fixed up adjoining the main house.
In Key West there is quite a furor about the shortage of affordable housing for our workers that can ill afford to live here so we had planned to do our share to ease the crisis by renting out an un used "Mother In Law Suite".
We had spent dollars we can ill afford in an ad in the newspaper and finally had a Coast Guard conscript that spends most of his time on a US Coast Guard Cutter patrolling our shores, happy to have found a place he could afford for $1,200 a month where he could un wind away from work.
My next door neighbor was acting funny and threatening We'll see you in court" so I smelled something was up and called a friend at the Zoning and Code enforcement division who confirmed that my neighbor had been in contact with the Zoning division and had a complaint, on file just waiting for the Coast Guard conscript to move in to bust me with a large fine, make a problem for the coast guard guy and hurt Clara's chances of gaining some income.
All Avenues for the Elder Clara are being cut off , HELP IS NOT FORTHCOMING and there is no possibility that Clara will be able to end her days in her own home .
I suggest you hang your heads in shame.

Country's Quickest Growing Crime, Elder Abuse
With the nation's fastest growing population the 85 and older crowd, crimes against the elderly are increasing rapidly, particularly in the financial sector.
"The biggest problem we have is an understanding of the seriousness of the crime," Beveridge said in a presentation at the Tehama County Supervisors' chambers Tuesday afternoon with District Attorney Investigator Martin Perrone and representatives of financial institutions and law enforcement.
A coordinator for Passages Adult Resource Center, Beveridge works with Passages employees stationed at nursing homes and retirement communities to monitor the treatment of the elderly. Passages' efforts expand beyond that, however, as the group can investigate on behalf of the elderly.
For law enforcement to investigate a matter an agency needs probable cause. Passages can help provide enough information to begin that investigation. But the group needs law enforcement to take these matters seriously.
Beveridge cited a Paradise case in which a woman was illegally taking money from her grandmother's account. With written permission from the grandmother, Passages obtained records showing the illegal withdrawals. In speaking to the thief, she gave a confession that was recorded.
With the evidence in place, Beveridge submitted the case to the Paradise Police Department.But
the department did not act ,he said.
"I called up for the stats of the case, and it was inactive," Beveridge said.
A call to the California Attorney General changed that and the woman is now being prosecuted.
To help prevent situations like that one, Beveridge said bankers who see their elderly clients abruptly signing away large amounts of money or expressing interest in giving someone power of attorney get in touch with Passages, the District Attorney's office, the Department of Justice and local police.
Suspicious behavior includes a "new best friend" and reluctance to look the teller in the eye.
"We do not need anything more than a suspicion to file one of these things," he said. "If you even think someone is getting rolled, send it to me."
Instances in which someone wishes to assign power of attorney often involve someone unaware of what that means, he said.
"[I've] had people want to sign over deeds of trust when they don't know what century it is," he said.
Difficulties are also posed when the abuse is coming from a family member. Mothers, fathers, grandmothers and grandfathers may be reluctant to turn their children and grandchildren over to the law, even when those descendants have addiction problems or have taken most of the money.
The best advice is for the elderly to learn as much as they can about their finances and refuse to sign anything they do not understand, Beveridge said.
Because the information is so important to the elderly population, Perrone asks members of the public to call him at 529-3590 if they would like to attend a second presentation.

Politics And Elder Abuse : In Bed Together ?

It never ceases to amaze me how closely elder abuse and politics parallel each other, when I read about world events and politics, I seem to be reading about elder abuse , only have to change a few words.
Re: the Pakistani Marriot Bombing credible eyewitnesses said that "all access to the hotel was closed off while the Marines unloaded steel boxes from a white US Embassy truck, bypassed both Pakistani and hotel security, and took these boxes directly to the fourth and fifth floors of the hotel -- just where the fires mysteriously broke out."
In a phone call to an Islamabad TV station, "a group calling itself Fedayeen-i-Islam" has claimed responsibility for the bombing of the Marriot Hotel in Islamabad, according to the Pakistani leading English newspaper Dawn.
Pakistani investigators yesterday said they had found new evidence of al-Qaeda's involvement in the suicide truck bombing of Islamabad's Marriott hotel. Intelligence officials also reported the arrest of up to five militants in connection with planning attacks.
Let's see now: The police are arresting members of one group while another group claims responsibility.
And there you have it; it doesn't matter who did it; it doesn't matter who claimed responsibility; it doesn't matter why Marines were acting mysteriously (and evading security) in the building shortly before it was attacked; it doesn't matter what evidence is collected during the investigation; it doesn't even matter whether there is an investigation.What matters is that the media and the politicians have already decided who's going to be blamed, and who's going to pay the price. And once again -- just like 9/11 -- it won't be the perpetrators.
And there you have it; it doesn't matter who did it; it doesn't matter who perpetuates elder abuse or exploitation ; it doesn't matter why perpetrators act mysteriously , isolate and drug elders before fleecing them ; it doesn't matter what evidence is collected during the investigation; it doesn't even matter whether there is an investigation.What matters is that the guardians , attorneys and judges have already decided who's going to be blamed, and who's going to pay the price. And once again -- it won't be the perpetrators.

Help for Florida Families Just a Phone Call Away!
With jobless rates still rising in Florida (we were up .5% from April - May 08 and up 1.6% for the year) and food costs going even higher, more and more working poor are falling in to crises. According to the Food Research and Action Center (FRAC) from March 2007-March 2008, the price of milk has risen 13.3%, egg prices rose 30%, cheese increased by 12.5% and bread costs 15% more. Caught in the squeeze many families are for the first time ever needing to reach out for help.
FRAC reports that 1.5 million more people nationwide participated in the USDA’s food stamp program in March 2008 as compared to March 2007. In Florida we saw an increase of 19% for the same time period. That’s an increase of more than a quarter million persons for our state alone.
From March 2003 - March 2008 we Florida saw a staggering increase of 37.5% in the number of persons participating in the program. What is even more amazing is that the USDA estimates that approximately 1/3 of all eligible households have not even applied for benefits.
Besides helping families purchase nutritious food, the food stamp program provides local economic stimulus. According to the USDA, for every $5 in new food stamp benefits, $9.20 is generated in local community spending. (Click here for the story from the USDA) They further estimate that a 5% increase in the national participation rate would create 2.5 billion in new nationwide economic activity.

Investors Seek Refuge from Financial Tsunami.- Gold Soars
``People are worried about money being safe in a bank,'' said Ron Goodis, the futures trading director at Equidex Brokerage Inc. in Closter, New Jersey. ``With paper assets in question, gold represents the textbook storehouse of value.''
``When you're perhaps facing a catastrophe in the U.S. financial market, investors are thinking: `Screw it. I'm jumping back into the old faithful,''' said Joel Crane, a metals strategist at Deutsche Bank AG in New York. ``Gold's relative value is cheap compared with the dollar.''
Russia halted stock trading for a second day and poured $44 billion into its three biggest banks in a bid to halt the worst financial crisis in a decade.
``You're sorting out, by process of elimination, that gold is the asset you'd rather own,'' said Greg Orrell, who manages the OCM Mutual Fund at Orrell Capital Management Inc. in Livermore, California. ``It's the currency you'd prefer.''
U.S. Treasury three-month bill rates dropped to the lowest since at least 1954. Investors pushed the rate as low as 0.0304 percent.
``It's not even worth it to keep money in the bank,'' said John Licata, the chief investment strategist at Blue Phoenix Inc. in New York. ``Gold is going to be the beneficiary of a global move toward a safe haven.''
``That's systemically scary,'' said Frank McGhee, the head dealer of Integrated Brokerage Services LLC in Chicago. ``Unless you put gold in your backyard, you have to trust your money to an institution.''
Gold's gains accelerated after prices topped $800, analysts said.
``There are going to be more banks that will fail,'' said Matt Zeman, a metals trader at LaSalle Futures Group Inc. in Chicago. ``This is the time when people want to buy gold.''

Time is running out to pass the federal Elder Justice Act (EJA). Victims of elder mistreatment should not have to wait for this comprehensive, multidisciplinary approach to elder justice to finally become a reality. If the legislation does not pass now, the whole process will have to start over again next year.

Help They Are Destroying My Family
After the car accident on August 29th, 2008 I have been in quite a deal of pain and having a hard time moving around.
Every penny we can scarf up goes to pay for my mother rapidly mounting medical expenses and to pay for those that are picking her bones clean in legal fees that we neither need nor asked for.

They Are Killing My Mother! With Seroquel
My mother, Yvonne Sarhan has been placed on *Seroquel, an anti psychotic medication used to treat Schizophrenia, however, my mother does not have Schizophrenia.
I called Dr. Steven Leslie Kaplan and asked why did you place my mother on Seroquel, he stated, for Insomnia. I asked why are you giving my mother 200mg at bedtime and 200mg in the morning, if it for Insomnia, why in the morning, Dr. Kaplan stated wow that is a high dose and he wrote the prescription, 3 months later my mother Yvonne Sarhan, is still being forced to take this medication. Why would you give my mother Seroquel which is a very dangerous medication, on the insert of the Box it states “Not To Be Given To Elderly People With Dementia Related Illnesses, can cause sudden cardiac death, strokes and diabetes, he said, “well you have to be careful.”
I have been a medical doctor for 16 years and there not one reason to give my mother this medication unless the guardians and the doctor would like to end my mother’s life so they can steal the rest of the money. Until now, I had no idea that a medical doctor would risk his patients life to assist the guardians in the theft of my mother’s and family assets. Dr. Steven Kaplan has been reported to the Florida Medical Board due to negligence, incompetence and criminal acts.
My mother is in a forced guardianship Case# 03-3440 in Miami Florida, which the whole case is illegal, I have been fighting 5 years to free my mother. On August 5, 2003, when my mothers Civil Rights were taken away, my mother was fully Competent, and was not in any need for a guardianship and did not want a guardian. She stood up in the Court and stated to Judge Bruce Levy, “Your Honor, if I have to have a guardian I want my son Robert, he is a medical doctor and a very loving and caring child.”
Six months after my mother was ruled incompetent, I took my mother to a Court appointed Psychiatrist and a Board Certified Neurologist and both stated my mother was competent, when we went back to court we asked Judge Bruce Levy, can we have my mother’s rights back now and Judge Bruce Levy Stated, “that she is not competent until I say she is Competent, denied,” even though my mother is competent, she remained in a forced guardianship against her will. I continue the fight to free my mother today.
The punch line is, 2 years into the case we found that Enrique Zamora was representing my mother and at the same time was representing the guardian of my mother and Zamora denied this representation, lying to the Court and the Court, Judge Norma Gerstein , did absolutely nothing but try to cover it up.
Judge Arthur Rothenberg did the same. Judge Celeste Muir is my mothers new Judge 305-349-7105 and the fax is 305-349-7137. Please help me save my mother’s life before they kill my mother, call the Judge, Fax your Senators and Congressman, State Attorney whoever will help.

Letters to Editor - Pray His Suffering Be Brief
My father's case involved an attorney who is now a judge. My attorney advises me to abandon any expectation of justice under these circumstances and he is concerned I'll be sued for defamation for reporting my father's abuse even though it was mandatory.
On the other hand, there is a sham judiciary commission investigation and I think even the slightest exposure in the press would probably result in her removal and disbarment.
We have a state attorney disciplinary board which could have nipped my father's exploitation in the bud had it followed its rules. I really think that would be the most effective way to stop legal exploitation, by the way. I'm sure you know there is much demand for new legislation to address elder abuse but, as current law is ignored, I see little point in enacting new laws to be ignored.

August Foreclosures Hit Another Record High
More than 770,000 homes have been repossessed by lenders since August 2007, when the credit crunch took hold.
The report from RealtyTrac, an online marketer of foreclosures properties, is the latest in string of bad news for housing.
Foreclosure filings of all kinds, including notices of defaults, notices of auctions and bank repossessions, grew 12% in August over July, and 27% compared with August 2007.
The 27% jump over last August represents a more modest year-over-year increase than in previous months, but that's only because the housing crisis was already underway in August 2007, which saw a big spike in foreclosures.
"In August 2008 the total number of U.S. properties that received foreclosure filings, as well as the national foreclosure rate, were both the highest we've seen in any month since we began issuing our report in January 2005," RealtyTrac CEO James Saccacio said in a statement.
Fannie Mae (FNM, Fortune 500) chief economist Doug Duncan isn't surprised by the swelling numbers. "It's been my view for a long time that foreclosures won't peak until the last three months of 2008," he said.
And now that the nation in a recessionary economy, with job losses exceeding 400,000 a month, Duncan speculates that the foreclosure crisis may be drawn out even longer.
"We've been saying that the foreclosure trend has not yet peaked," said Doug Robinson, a spokesman for the foreclosure prevention organization NeighborWorks America. "Before it was a subprime problem," he said. "Now, it's everybody's problem."

The War Comes Homes

Someone asked me recently how my mother died. I simply responded, "She got into a delivery system and I couldn't get her out."
"Delivery system" is a term I picked up from an FBI agent. It is a euphemism for the extermination process which has begun in the U.S. This process--which will result in the eradication of the Jewish population--is obviously not being publicized. It is at considerable personal risk that I am attempting, through a series of articles, to expose this agenda before it is too late. It is already too late for my mother. It may not be too late for others. Therefore, I consider the risk immaterial.
Amalie Muriel Strauss Deren Phelan came from German Jewish stock, although she was born in the U.S. Educated on the East Coast, she received her Master's degree from Cornell University and her Ph.D in Clinical Psychology from Syracuse University in upstate New York.
At the age of 21, she married Solomon Deren, M.D., a professor of Psychiatry at S.U, and several decades her senior. Deren had escaped from Russia during the pograms in the early part of the 20th century. When he died of a heart attack seven years into their marriage, Amalie moved to Alton, Illinois, where she worked in the state psychiatric hospital. In Alton she met my father, James Phelan, who was at that time a fledgling reporter at the Alton Evening Telegraph. Six weeks later they married and remained so the rest of their lives.
My father went on to considerable prominence in his field. He worked as an investigative reporter at the Saturday Evening Post, as well as publishing widely as a free-lancer in national publications. His first book, "Howard Hughes: The Hidden Years," made the cover of Time Magazine in 1977 and became an international bestseller. He went on to author two more books, the latter of which he worked on while he was terminally ill with lung cancer. He received the advance copies from Random House the week before his death in the summer of 1997.
He did not know at what terrible risk he left my mother.
When I was a child, my mother used to sit on my small bed at night and tell me stories about her own childhood. One story I never forgot.
A young classmate followed her home from elementary school chanting, "Dirty Jew! Dirty Jew!" I recall experiencing enormous relief that our society had advanced to a point where I would never experience such a hateful and unprovoked attack. Little did I know at that time what lay in store for us.
The particulars of how Amalie Phelan was "delivered" is an extremely personal story. It is a recounting of the absolute refusal of our system to protect her life. It is imperative that, as you read this greatly abbreviated account, you understand that at many junctures there could have been intervention by societal safeguards--the courts, the police, Adult Protective Services, the District Attorney's office--which could have prevented her untimely demise. The fact that there was a blanket exodus from her situation is most telling.

Idaho says Zyprexa is a costly drug that has been improperly marketed,sickening Idaho patients and taking a financial bite from the state's Medicaid health insurance program for low-income and disabled people.
The firm denied improperly marketing Zyprexa and said it issued warnings that the drugs can cause diabetes and weight gain, so these effects shouldn't have surprised Idaho officials.
All but a handful of states are involved in litigation with Eli Lilly over the drug or are talking with the company in hopes of avoiding lawsuits.Scores of individuals also are involved in cases.
So far, Alaska is the only state to settle with Eli Lilly. The state was awarded $15 million this spring.
About 10,000 Medicaid patients in Idaho have been prescribed the drug, which retails at one Boise pharmacy for $813 for a 30-day supply of 20 milligrams a day.
Deputy Attorney General Brett DeLange did not know Tuesday how much the drug cost taxpayers through the Medicaid program or how much Medicaid money has been spent to treat diabetes, obesity and other health problems he said are side effects of Zyprexa.
"It's not just the cost of the drug" that concerns Idaho officials, he said. "It's the effects of the drug, the long-term treatment for people who are diabetic or severely obese now."
The U.S. Food and Drug Administration has approved the drug for treatment of adults with schizophrenia and bipolar disorder. The company is seeking approval to treat the same disorders in teenagers.
The Idaho lawsuit contends Eli Lilly illegally marketed Zyprexa for "off-label" uses not approved by the FDA..
In Idaho, marketing efforts directed at doctors encouraged them to prescribe Zyprexa for "anxiety, phobic disorders, neurotic depression, affective personality disorder, sleep disorder, depression, attention deficit disorder, insomnia and separation anxiety," the lawsuit says.
"None of these indications were approved by the FDA," the lawsuit said.
It's not uncommon for doctors to write "off-label" prescriptions, but drug companies are not allowed to market their drugs for off-label uses.
Eli Lilly spokeswoman Marni Lemons said the company did not endorse Zyprexa
for those conditions, but she said many mental-health conditions are difficult to treat, and doctors may try Zyprexa to help patients find relief.
"Because of the stigma of these disorders, I don't think people have any idea how widespread the use of these antipsychotics are," Lemons said.
Eli Lilly on Friday filed court documents moving the case to federal court in Idaho. Next, Eli Lilly plans to merge the Idaho Medicaid case with similar cases in a federal court in New York, Lemons said.
That doesn't sit well with DeLange. "We will be responding and asking the judge to send it back," DeLange said.
Idaho laws were broken, and Idaho should decide the case, he said.

My mother was put on all three drugs, just because she cried for me after Iwas wrongfully banned by the unscrupulous nursing homes from seeing her(after I reported horrible abuses and neglects to Texas DHS). I still have videos of the before and after drugs, I helped expose TMAPS and I pray thatI will help put these elderly vultures behind bars, where they belong.

Your Drinking Water could be Tainted

Testing prompted by an Associated Press story that revealed trace amounts of pharmaceuticals in drinking water supplies has shown that more Americans are affected by the problem than previously thought -- at least 46 million.
(AP) -- A vast array of pharmaceuticals -- including antibiotics, anti-convulsants, mood stabilizers and sex hormones -- have been found in the drinking water supplies of at least 41 million Americans, an Associated Press investigation shows.
But the presence of so many prescription drugs -- and over-the-counter medicines like acetaminophen and ibuprofen -- in so much of our drinking water is heightening worries among scientists of long-term consequences to human health.
"We recognize it is a growing concern and we're taking it very seriously," said Benjamin H. Grumbles, assistant administrator for water at the U.S. Environmental ProtectionThere are plenty of reasons offered for the secrecy: concerns about national security, fears of panic, a feeling that the public will not understand — even confidentiality agreements.
In Philadelphia, the water department has not informed its 1.5 million users that traces of 56 pharmaceuticals or their byproducts — like the active ingredients in drugs to treat depression, anxiety, high cholesterol, fever and pain — have been detected in the drinking water, and that 63 pharmaceuticals or byproducts had been found in the city's source watersheds.
Initially balking at the AP's request to provide test results, Philadelphia Water Department spokeswoman Laura Copeland said, "It would be irresponsible to communicate to the public about this issue, as doing so would only generate questions that scientific research has not yet answered. We don't want to create the perception where people would be alarmed."

I posted this article after researching Janet Phelan claims that the water supply could be used as a delivery system, I like other Americans was doubtful of this. So I did a little research.
But NOT to worry I'm sure the drugs got there accidentally, and the pharmaceuticals are only there in small amounts. No need for concern! What to make of this? I don't know , but I thought you might want to know.
