War on the Elderly ! - Rense & Marti Oakley – Guardianship – Theft, Looting And Murder

It happens everyday in every state. Elderly or disabled individuals are kidnapped under the guise of “guardianship” by predatory guardians who then begin bleeding off the estate.

Corrupt probate judges, attorney’s, social agency workers, nursing home operators, doctors and the ever present predatory guardian, all begin hammering away at the vicitms assets until nothing is left. The family is restrained from visitation while hearsay charges are levied against them by the predators. No evidence required.

If you think this can’t happen to you, think again. Congress is well aware of this crime. Your state agencies, police departments, state attorney’s general, the FBI, the DoJ …all are fully informed and yet refuse to do anything to stop this theft and looting while holding an elderly or disabled victim hostage.

This email was interesting apparently the Senator knows about the corruption. As a lawyer how could he not know? What I find interesting in his question that anyone out here has any suggestions of how to tackle the problem that now engulfs all the states. Dale you make a very good point, when I visited Latin countries recently it is a well established fact that we take care of our own and I was hard pressed find a nursing home, when I did find one it was administered by Catholic Nuns you can see it here after a brief intro: http://www.metacafe.com/watch/988402/a_nursing_home_in_the_dominican_republic/

All the work we performed by volunteers in a loving fashion, with weekend outings to the beach, etc.... When I asked how much it cost to keep an elder there, the cost was -0- .Work was all done lovingly by volunteers! for free!I was informed that the the reasons that they were there because they were the last of the line. Watch the video, when I asked if I could take pictures they said "Why Not?" in contrast in the US it costs thousands to keep an elder there, under conditions so bad that they shudder should you ask to take pictures! What a shame, How could the American people be so indifferent? Do they think that they are immune to the ravages of time? Dale another explanation is that American society has been brought up to be so materialistic that to go go out and earn a buck is more important than for any members of the family to take turns taking care of grandma/pa , elders are not bringing any money home therefor they are useless eaters to be confined to die in a old's people warehouse, this is so well established in American society, that any of us that want to take care of the old folks are seen as an anomaly, there must be something wrong with us, or we must have ulterior motives! It is not normal! We must ostracized. Then there is the financial aspect, if they are broke, no ones cares, if they have saved up for their old age, then surely you must not be allowed to take care of them, you must have other motives, and that must not happen, a guardian and his armies of attorneys, fiduciaries must me put in charge, no matter how many lives they destroy in the process, only and only if they IP incapacitated person survives the process when the money is gone are you allowed a chance to care for them, as is the case with my mother Clara G. Fernandez, (well documented here) after 5 years of legions of attorneys gorging themselves at the probate feeding trough , were we allowed to take care of her, but only when all the money in the Trust was gone. I always thought that elder abuse should be a crime and not just a civil matter, until elder abuse becomes a crime and the perpetrators are held accountable even when they happen to be family members this horrendous crime is due to rise to epidemic proportions, laws are written by attorneys and until attorneys who make their money by putting the elders in Guardianships are held accountable for their crimes against the elderly I see little hope for America's aging population who fall between the cracks from being exploited.

Too Many Voices, Too much Suffering!

Originally the guardianship laws were written with good intentions. Unfortunately, greedy lawyers and others saw a cash cow and the rest is history.

Everyone should send this video to everyone they love before it is too late and they are snagged by the guardianship courts where they will lose their money, their freedom and sometimes even their lives. Guardianship and conservatorship are a modern day holocaust.

Sometimes adult children are abusing drugs or alcohol, sometimes they’re resentful of their childhoods and feel their owed, and sometimes they’re simply opportunistic, but financial exploitation by children of their elderly parents is a problem only now beginning to be widely reported.

"A lot of people think it’s within the family so it’s a civil matter, and some people even think, ‘Well, I’m going to inherit the money anyway, so I’m just collecting my inheritance early,’ " said Marta Fontaine, adult protective services planner for the health and senior services department. "We’ve seen it get to the extent where someone gets the deed to a home or opens joint bank accounts. People have signed over CDs. It can be quite extreme."

Fontaine said this area of the law is relatively new. Missouri first passed a financial exploitation of the elderly and disabled statute in 2000. It has been revised twice to make it easier to prosecute criminals.

"Nationwide, prosecutors are just now starting to understand undue influence and how that can make what may appear to be a civil matter into an actual criminal matter," Fontaine said.

Financial exploitation of an elderly or disabled person of greater than $1,000 is now a Class B felony in Missouri and rises to a Class A felony if the sum is greater than $50,000.

Still, said DHSS officials who monitor the Elder Abuse Hotline, only about one out of every 14 cases are ever reported.
