We are cooperating in an effort to bring the abuses suffered at the hands of the legal system to the forefront. Our Elderly, Disabled and otherwise Infirm are being legally fleeced by court appointed Guardians, Fiduciaries, Conservators and their Lawyers.

Some elderly persons are losing control of their own lives without ever being given the chance to speak out---everything is stolen from them "ex parte", which means it is done in a proceeding "without their presence or participation."

Even when the Elderly and Disabled are ALLOWED to participate in the proceedings, our Parents, Grandparents and Friends are considered "incompetent" for a variety of reasons, including the random act of kindness of opening their hearts and homes to the homeless and less fortunate. The term "incompetent", I've learned, is a very flexible, slippery slope, wielded as a tool to steal from those who can do nothing about it.

Inheritances are being redirected from the rightful heirs, into the system by judges that "look the other way" when loopholes are brought to their bench, while a long line of strangers pocket the life savings of vulnerable persons.

Since when is it in the "Clients" best interests to take away their freedom and their savings, only to force them into a nursing home as a ward of the state with the taxpayers bearing the costs for the balance of their life---while the court appointed Guardians, Fiduciaries, Conservators and their Lawyers put their fees in the bank?

Since when is it in the "Clients" best interests to throw their family histories, historical documents and family photos and heirlooms in a DUMPSTER?

Since when is it in the "Clients" best interests to take their family away from them by court order---leaving them in the hands of strangers who have no true interest but a financial one?

IT IS A MATTER OF LAW that no one in this great Country will have their life, liberty or property taken from them without "due process of law", yet the rights of the elderly are violated EVERY DAY!

• This year, the first wave of baby boomers are turning 65 – and with increased age comes increased risk of developing Alzheimer's disease.

But, while Alzheimer’s kills, it does so only after taking everything away, slowly stripping an individual’s autonomy and independence. Even beyond the cruel impact Alzheimer’s has on the individuals with the disease, Generation Alzheimer’s also details the negative cascading effects the disease places on millions of caregivers. Caregivers and families go through the agony of losing a loved one twice: first to the ravaging effects of the disease and then, ultimately, to actual death.
• "Most people survive an average of four to six years after a diagnosis of Alzheimer’s disease, but many can live as long as 20 years with the disease. As the disease progresses, the person with dementia requires more and more assistance with everyday tasks like bathing, dressing, eating and household activities," said Beth Kallmyer, senior director of Constituent Relations for the Alzheimer’s Association. "This long duration often places increasingly intensive care demands on the nearly 15 million family members and friends who provide unpaid care, and it negatively affects their health, employment, income and financial security."
• In addition to the human toll, over the next 40 years Alzheimer’s will cost the nation $20 trillion, enough to pay off the national debt and still send a $20,000 check to every man, woman and child in America. And while every 69 seconds someone in America develops Alzheimer’s disease today, by 2050 someone will develop the disease every 33 seconds - unless the federal government commits to changing the Alzheimer’s trajectory.
• "Alzheimer’s – with its broad ranging impact on individuals, families, Medicare and Medicaid - has the power to bring the country to its financial knees," said Robert J. Egge, vice president of Public Policy of the Alzheimer’s Association. "But when the federal government has been focused, committed and willing to put the necessary resources to work to confront a disease that poses a real public health threat to the nation – there has been great success. Elder Abuse is far more Rampant than Evidenced : For Every Case of Financial Exploitation Reported, 44 Cases go Unreported

In recent months, a Fall River family was arrested for criminal neglect of their grandmother who was admitted to the hospital with bedsores so deep they exposed muscle and tendon. A Topsfield man pled guilty to involuntary manslaughter of his mother after an abusive episode of yelling and striking his mother with a telephone resulted in fatal injuries. A Hyannis stockbroker awaits trial for swindling elderly clients out of hundreds of thousands of dollars of their hard-earned savings. Elderly abuse is often hidden because it is frequently perpetrated by family members, close acquaintances, and caregivers, but it occurs in every community in the Commonwealth.

For nearly three decades, Massachusetts has had laws in place to protect elders from abuse. But statistics now show that abuse within one of our most vulnerable populations is increasing at an alarming rate. When Massachusetts established the elder protective services program in 1984, 1,500 reports were filed, but this year that number jumped to 19,500 reports – that equals 54 new cases each day. Nationally, a recent Cornell University study found that elder abuse is far more rampant than evidenced by reported cases. For every case of financial exploitation reported, 44 cases go unreported. For every case of neglect, 57 cases go unreported.

Elder abuse is not just physical and sexual violence; it also includes emotional abuse, self-neglect, and financial exploitation. Stealing from seniors and other forms of financial exploitation adds up to more than $2.6 billion a year nationally according to a report by Metlife’s Mature Market Institute. In this economy, personal savings, home equity and other “nest eggs” make seniors particularly vulnerable targets. Since family and caregivers are the perpetrators in 55 percent of the cases of financial fraud against seniors, these crimes often go undetected, and it is often difficult for well-intentioned family members or friends to strike a balance between a senior’s right to make independent decisions and intervening to protect them.

Elder protective services are funded through the state and, like many essential services, are suffering in a difficult budget. These appropriations not only cover the costs of investigators statewide, but also an elder abuse hotline, legal expenses, guardianship appointments, and a money management program for elders struggling with daily finances.

Since FY 2009, funding has decreased by $800,000 resulting in many cases being only partially investigated. While the governor’s FY 2012 budget level funds protective services, abuse reports have risen by nearly 29 percent. To address this crisis for our seniors, we have filed legislation that calls call for a comprehensive approach to elder abuse by establishing a commission of experts to analyze the problem in Massachusetts and make recommendations for coordination of services and changes in law if necessary. This special commission will investigate ways to improve our elder protection system by developing prevention methodologies, pro bono resources to assist elders and protective services agencies, and multidisciplinary case review teams.

Senior abuse creates financial, emotional and physical burdens for its elder victims and their loved ones. The more seniors injured, the more government will pay to care for them, and the more difficult it becomes to keep at-risk seniors in the community. By raising public awareness of this growing problem and giving our protective service agencies the resources they need, we can improve the quality of life for seniors in the Commonwealth. Prevention and detection of elder abuse is everyone’s business. Watch out for the seniors you know and report suspected abuse.

Another Approach to Probate Corruption

This is an interesting approach that might help open criminal investigations into abusive probate cases. It was suggested by a grassroots activist in Arizona.

I would recommend that you post on your blog for probate victims to contact their Congressman/woman and request a “Privacy Act Consent Form” be sent to them so that they can request investigations by the FBI and U.S. Attorney in their states.

It is also very important that they prepare an affidavit with the following:

1. Concise factual statement to the point.
2. Concentrate on the most outrageous instances of abuse and how they (judges,attorneys,fiduciaries and guardians) intended the reasonable consequences that ensue, that is, raiding of the estate.
3. Show a common theme that will help establish the conclusion that judges, fiduciaries, attorneys and guardians are participants in a pattern of wrongdoing that satisfies the elements of a corrupt enterprise under the federal or state RICO laws.

My flow charts are what is know as a “sociogram” which the FBI uses to bust criminal syndicates as they just did two weeks ago. I would recommend that the victims make a sociogram of their cases to submit to their Congressman, U.S. Attorney (in their state), FBI and Attorney General. Our PAC Committee for Judicial Accountability, Reform and Justice (CJARJ) will be offering help to our members in preparing their “sociograms.”

EstateofDenial.com has long said that any meaningful change to the racket currently functioning as today’s probate system will only occur in response to challenges on multiple fronts. In other words, you’ve got to come at this from all directions. And here is another direction.

Thanks to our friend, Ray Fernandez, at ElderAbuseHelp.org for calling attention to this article from the National Inflation Association. The law school/legal industry aspect of this piece has a significant tie-in, we believe, to probate abuse.

Here in Texas, higher education funding is going to be a big topic in our legislature. With that, the NIA article inspired an new (unplanned, but irresistible) EoD column entitled Will 2011 bring the bursting of a “college bubble”?

As the Texas legislature along with many other state governments prepare to grapple with budget shortfalls and spending cuts, public college and university funding are likely to come under great scrutiny. With that, a recent National Inflation Association article warns that the bursting of a “college bubble,” akin to the real estate bubble, could happen this year and bring widespread consequences.

We agree with the article’s basic premise that too many of today’s high school students are being funneled into college for purposes that better serve the employment and power-coalescing machines associated with higher education rather than helping to prepare all of these young people to be productive members of society. College is an appropriate and important path for some students, however, others may find technical
or skills-based training facilities – especially with a clearly defined field of interest – a far more beneficial and cost effective course.

As higher education costs rise, many of these kids are being encouraged to take on debt disproportional to the earning power their degree or certification will ever generate making this a decision with long-lasting and financially detrimental consequences. And unfortunately, it’s members of the higher education industry or their surrogates that encourage this action. We wish more financially responsible parents were in the mix so as to better counsel their children, but that general absence contributes to this and many other troublesome societal trends.

Friends and associates with recent experience on college campuses tell stories of waste, even fraud, associated with Pell Grants. We know respectable, productive people who say that without such funding, their college experience might have been unattainable or at least far more difficult. Today’s climate, however, also encourages disinterested and unmotivated students seeking only to “scam” the system. This disservice is perpetrated by the higher education industry and other politically correct allies promoting a false sense of education equality over sensible public policies. And who is hurt in this equation? Legitimate students genuinely seeking to maximize educational opportunities, American taxpayers who foot the bill and American businesses that can’t find appropriately qualified candidates to fill positions.

This column additionally attracted our interest at EstateofDenial.com because of this reference to higher education and the legal industry:

All across America, thousands of students are graduating law school each year with $250,000 in debt, but with no jobs at law firms available to them. 15,000 attorney and legal staff jobs have disappeared since 2008, yet 43,000 law degrees are being handed out each year. Law degrees are losing their value faster than the U.S. dollar is losing its purchasing power. Lawyers are non-producing workers that do nothing to create any real wealth for society. The artificially high incomes of lawyers are made possible entirely by inflation, which steals the wealth from hard working goods producing middle-class Americans and transfers it to those who add no real value to society.

With estate abuse and probate corruption as our focus, we address all aspects of the issue. EoD reports on how many estate disputes (via wills, trusts guardianships or powers of attorney) are contrived so as to generate billable hours for the involved attorneys. It’s a form of barratry, a criminal practice involving the generation of profit for legal services by an attorney who stirs up a dispute and encourages lawsuits in order to file a groundless claim. With the aging Baby Boomers, extended lifespans and families not living in close proximity as once was the case, one can reasonably wonder that a supply of unemployed or under-employed lawyers might find probate an appealing growth area. It’s a position that bodes badly for an unsuspecting public whose assets now become “up for grabs.” These conditions also illustrate the college scam concept of self-serving universities aggressively recruiting students to potentially assume great debt for entry into a professional field with diminishing opportunities.

This National Inflation Association column isn’t an across-the-board discrediting of college educations. It merely offers timely comparative data, substantive reasoning and good advice to the youth of America today to “think for yourselves.” It’s perspective that adults in these young people’s lives would also do well to adopt.

AS I prepare for another day the sounds of diverse languages drifts in through my window, like Santiago, a breath of fresh air and freedom, no mailman delivering threatning communications demanding things, no real estate tax bill to pay or court hearing to go to, a place where the mantra "The best government is the one that governs the least" is music to my ears, my only question as I read Simon Black's letter is what took me so long? a letter I 'd like to share with you....

Yesterday evening I was walking around the beautiful tree lined streets of Providencia, one of Santiago's central upscale districts.

I might as well have been walking around Berlin or Strasbourg-- Providencia is a clean, highly civilized area with plenty of parks, cafes, and boutique shops that adjoin the neighborhoods of manicured homes and quiet mid-rise condominium buildings.

On the streets its common to see a host of walkers, runners and bikers-- Santiago is a very 'outdoors' city, much like Austin or Vancouver, and with such beautiful mountain vistas and great weather, it's easy to understand why.

What's interesting is the number of languages that you can hear being spoken while walking around town-- the varied nationalities that have made Santiago their home is staggering for a country of this size (17 million).

It's common to see the token French, German, British, and American expats... but in addition you come across people from all over the world-- Africans, Taiwanese, Thai, Russians, and even Iraqis.

Chile has become one of the countries in a growing list that welcomes foreigners with open arms-- people who are willing to work hard, add value, or bring in capital are respected and treated well.

This is the same approach that has worked in places like Hong Kong and Singapore; these are two countries where just about every nationality on the planet can enter without a visa.

Propping the door wide open for foreigners provides significant economic benefits; people are more likely to visit (and spend their money) in a place where they are treated well, and they're more likely to do business in a place where they feel comfortable.

The exact opposite end of the spectrum is the United States... and to a growing degree, the UK. Foreigners who arrive to the US are subjected to discourteous, disrespectful measures and made to feel like lowlife criminal terrorists.

For many, it's an absolutely horrific experience. Maria C., the Chilean lady who owns the apartment I'm renting in Providencia told me yesterday about her most recent-- and last-- trip to the United States.

The Department of Homeland Security decided that, instead of being a well-respected Chilean national attending her Harvard reunion, she was a suspected Colombian drug trafficker. DHS detained her for over 12-hours, confiscating her purse, her passport... even her shoes.

She was continually interrogated by DHS officials who played good cop/bad cop mind games, and when she was given 'permission' to use the bathroom, it was under close-up video surveillance. They finally released her without so much as an explanation, let alone an apology.

Maria's story is unfortunately common; Homeland Security's Customs and Border Patrol division takes itself way too seriously, and its uniformed chimpanzees are convinced of their own righteousness... that their actions are actually defending the homeland.

One recent story makes this attitude abundantly clear. It involves a Canadian woman, Lind Bird, who was stopped, searched, and relieved of her $2 Kinder Surprise egg by US border patrol agents.

Kinder Surprise eggs are a type of European chocolate candy, and they're considered illegal in the United States because the FDA has deemed them a choking hazard for children.

The eggs are perfectly legal in Canada, and Bird had one in her vehicle as she was crossing the border. After a stern talking-to by agents, Bird's egg was confiscated by the United States government, who subsequently sent her a 7-page letter demanding that she authorize the 'destruction' of the egg.

Stories like this are so ridiculous that they border on satire... and yet they're entirely true.

Rather than wasting taxpayer dollars such nonsense, the US government should be rolling out the red carpet for all nationalities with welcome signs saying "Thank you for spending your hard earned savings in our economy... and while you're at it, please consider mopping up our excess housing inventory!"

I mention housing because it's such a massive problem; the latest census data shows that there are 19 million vacant homes in the US... and climbing. There are only a handful of ways to clear out this surplus.

First, the country can wait it out until a new generation of Americans comes of age, moves away from mom, and establishes a new household. Given the country's anemic growth rate over the last decade, this option will take years. And years.

Second, the excess inventory could be consumed by a sudden surge in Americans' wealth that sends them on a shopping spree for second and third homes.

Considering that the government has spent a few trillion dollars to create a few hundred thousand temporary and low-paying jobs, however, this seems unlikely.

Third, foreigners could provide the much-needed influx of people and capital that are required to purchase and fill the surplus of homes. Given the way that the government has so distastefully mistreated foreigners over the last several years, however, those cries would likely fall on deaf ears.

Just ten to fifteen years ago, if the US housing market had been in a similar situation, foreigners from all over the world would have been lining up to buy cheap property in the states; there was no greater status symbol than having a home in New York, San Francisco, or Florida.

Today, foreigners understand that the world is a big place, and that there are dozens of other countries that will treat them like human beings, and offer attractive incentives to boot.

Latvia is one country already taking this step, offering EU residence to anyone that purchases real estate subject to minimum criteria (I'll have a lot more actionable information about this in our upcoming edition of Sovereign Man: Confidential, due out this weekend).

Meanwhile, the US government will continue to treat visitors like criminals, scare citizens about terrorist threats, and wrap itself up in a blanket of righteousness... all while failing to realize that instead of protecting the homeland, these policies take an active role in the destruction of the economy.

By the late summer of 1939, Hitler's forces had absorbed Austria and Czechoslovakia into his growing empire, and Germany's military was massed at the Polish border clearly preparing for invasion.

In an astonishing display of perhaps the greatest complacency in the history of the modern world, however, Polish people sat lazing about their lakes, beaches, and riverbanks worrying about more pressing matters-- like how to beat the summer heat.

In September of that year, German troops easily vanquished the Polish army, and Krakow became the colonial seat of the occupying forces. Almost immediately, under the direction of the German SS, anyone who posed a threat was rounded up and imprisoned. This included over 180 Polish university professors and many businessmen.

Krakow, of course, is also very close to two of the main concentration camps used during the German occupation, nearby Oswiecim (Auschwitz) and Plaszow.

The worst part is that, even after the war was over, Poland merely swapped fascism for Stalinism. Overall, the country was shrouded in brutal totalitarian control for half a century; undoubtedly, the Nazi invasion of Poland set off a chain of events that would forever affect the lives of all Poles.

It's true that no one had a crystal ball back then... but it would certainly stand to reason that with Hitler knocking at your door, you would probably want to have an escape plan. Even more prudently, perhaps to have already executed it.

Many Poles did just that; they spent the preceding seasons liquidating assets, stocking up on gold, and getting their travel documents in order. By the time Hitler came to town, many of the smart ones were already gone.

My guess is that the ones who left were probably ridiculed by their peers as "crazy", or "fringe", or "out of touch", or my personal favorite, "unpatriotic." It's as if they had a solemn national duty to stay, get roped up and waste away in a concentration camp for the 'greater good' of Poland.

For those who escaped before the war, many of them went on to build new lives in places like the United States, Brazil, and Argentina. They prioritized freedom and opportunity, and they went to the best places that were safest for themselves and their families.

I've met a businessman here (I'll call him "Jarek") who I think has the best story to sum this up; when Jarek's father was just a boy in Krakow, the family saw the warning signs and decided to leave town. This was 1938.

Jarek's grandfather owned a successful bakery at the time, yet he felt that he would rather start over somewhere else than risk the safety of his family by living in a police state. They sold everything-- the house, livestock, and business... and everyone else thought they were crazy.

Within six months, the family was in Curitiba, Brazil; Jarek's grandfather soon established a new bakery that eventually became a thriving business. Jarek's father grew up in Curitiba and integrated into the local culture, yet he maintained his roots since there were many other Poles who followed them there.

30-years later, the face of Brazil started to change. By the mid-1960s, the whole of Latin America was becoming a military dictatorship. Once again, the family decided to get out while they could and head towards better opportunity; they sold the business, liquidated their assets, and this time headed towards the United States.

Jarek was just a baby when the family made this move. He grew up in a Polish neighborhood of Chicago, spoke Polish at home, and married a Polish girl from his neighborhood.

He was working as a young real estate professional in the Chicago suburbs when the Berlin Wall fell, at which point he began making more frequent trips to Poland to visit his family's homeland.

In his subsequent trips throughout the following years, Jarek began feeling like there was more and more opportunity in Poland; in 2003, fearful of what would happen in Chicago because of the "War on Terror," Jarek moved his family full-circle back to Poland because he felt like it was the safest, most opportunity-rich place for him to be.

He may have been right; his business is booming, and the family really enjoys the life they have built for themselves here. To listen to him talk, though, they would happily leave and go somewhere else if the right circumstances were presented.

Defeating Moral Equivalence

While I served to protect the principle of free speech, I detest when people choose to follow perceptions rather than reality and attempt to rewrite history. Especially when those people equate the honor and sacrifice displayed by the members of the U.S. military with the evil perpetrated by the Taliban.

To those who cast aside reason in this manner, I ask: What do you stand to gain by taking the position that the U.S. is no worse than the Taliban?

To compare our military to the Taliban is so far fetched is probably not worth the time or space in this blog. Our military is one of the most disciplined and well trained in the world with the best of the best of young men and women our diverse towns and cities have to offer.

Now some of our civilian politicians and people in power, that a different story!

As Editor of ElderAbuseHelp.Org I received letters daily, some of which I post, where older people are incarcerated without a trial in institutions against their will, their properties confiscated by greedy court appointed guardians who often buy the properties through a front at reduce prices only to flip them for personal gain(documented-public records) and isolate and restrain family members from seeing their loved ones,forcing the prisioners, the prefer to call them (residents) or (Wards)to experimental drugs and denying family members the information of when or how the died, citing privacy concerns.

These are not isolated concerns but rather a sustained attack on a class of people deemed useless to society, leaving their family destroyed,isolated, and broke from the length and costly legal (one way) battles to free their loved ones. Note: Some elder don't adapt well to an institution and this is a certain death sentence.

This when there are family members wanting to take care of their own but denied because the army of guardians,guardian attorneys,leeches and other low lives profit handsomely from the situation.

These cases are too well documented to pretend this isn't happening, the loss of civil rights and incarceration and submission to drugs to keep docile, claiming that the courts know better what's good for these people while draining their account, separating families and denying their loved ones contact with their families is tantamount to torture.

The Taliban kills you relatively fast, these people torture you for years, and take away all humanity leaving a lot of us wishing we were dead.

Which is worst the Taliban or some of the low lives in power who would rape your dog if there were money in it.

I don't know it's a close call...........

You can delete if you feel compelled to hold back the truth to protect the criminal ruling class that no longer represents the 'people' I say the truth because these are real letters from real people who are suffering from having their families separated, their doors kicked down and their relatives led away often never to be seen again! To follow up on my posting please allow me to post one of the hundreds of letters like this I received everyday which overwhelms me, makes me sick, is this what our fathers sacrificed for?

Though I talk to my mother nearly every day on the telephone, I have not seen my mother in nearly 6 years, since the hearing of October 27, 2004 and I need to see for myself if my mother has gained weight due to the elderly killer drug Zyprexa. At that hearing, the last hearing, my mother was ordered out of her home instead of honoring her demand for her right to honest evaluation by a real doctor. The judge, Judge Munsinger, stated during his ruling that day, that he would deny all my mother's or my future pleadings.

The guardian has threatened me with false arrest several times, the most recent in spring of 2009 claiming my request for medical records was a crime. The guardian has ignored the "encouragement to discuss medical" with me, that is part of the guardianship orders.

The guardian's lawyer threatened me with a harassment charge for my leaving a very polite message on the guardian's voice mail asking to see my mother for Christmas 2004 stating my message was "an attempt to circumvent the rules for visitation."

Those rules were written up by the guardian's lawyer, built on false accusations and for me to sign them would be signing a confession. Among those rules was a rule that states that I cannot bring up the "events of May 8, 2003." On that day the guardian brought police and broke down my mother's door, dragged her out of her chair when she could not get up fast enough, handcuffed her and took her to emergency mental ward on false pretenses. You have the story of this day and the recording my mother left on friend of the family Frank Sampson's answering machine.

The Judge rubber stamps everything the guardian wants.

Just what can I do to see my mother?

We’ve published an interesting blog post out of Florida on the attitude and actions of that state’s Bar and Supreme Court with regard to attorney misconduct. It makes some great points that can likely also apply to other states with regard to attorney misconduct and attorneys’ obligations to report bad acts.

Florida seems to stay on our radar of late and speaking of heavy-handed public officials, thanks to Paul for calling attention to this tragic story out of Naples regarding a woman who wants nothing more this Christmas than for her parents’ guardian to allow a family visit. Naplesnews.com reports that the parents are now residing in an assisted-living facility with the father, Marcel Vozzella, allegedly drugged due to expressing unhappiness with being removed from his home and separated from his daughter. Meanwhile, also reported is that $40,000 per month is being spent to pay the couple’s expenses. Wonder if that includes the guardian’s fee?

Getting this story late Christmas Eve afternoon serves as an important reminder for our audience to recognize and appreciate that for which we have to be thankful this holiday season. But also, get ready for 2010. This next year will be a bumpy one, but as someone far smarter than us once said, anything worth having is also worth fighting for. To those fighting probate corruption/estate abuse as well as others determined to battle the additional threats to American liberty and property, prepare as a big year with the prospect of much progress is ahead.

Government is currently working to confiscate our property through certain legislation as well as onerous and ever-growing taxation. Our liberty is additionally at risk through efforts to diminish basic rights. I could go into numerous examples, but you well understand things that are going on.

People are rightfully concerned. To think that with all that's happening that government is suddenly going to be hyper-sensitive to the "rights" of elders is naive. Now is the time to point this out. Lip service will certainly be given as it makes for good press and "feel good" measures will abound, but the sad reality is that many people - including those connected with and/or influencing government - profit from the exploitation of our elderly and it's a revenue stream that will not be easily given up.

Developing the Involuntary Redistribution of Assets (IRA)terminology was to help position the use of probate mechanisms as a threat to property rights. It's part of a long-term strategy and who knew current events - frightening as they are - would provide such a compatible backdrop. Bottom line - to criticize what is happening to our elders in America today isn't un-American - it's completely pro-American for people who seek to preserve basic rights and economic principles that many of us believe helped make this country great".
