The United States has 2.3 million people behind bars, more than any other country in the world and more than ever before in its history.
The number represents an incarceration rate of 762 per 100,000 residents, compared to 152 per 100,000 in Britain, 108 in Canada, and 91 in France, HRW said in a statement commenting on Justice Department figures also released Friday.

Wow! 762 per 100,00 residents compared to 91 per 1000 in France and I thought the French were kidding when they compared in Le Monde's Jean-Marc Manach has an article in France's newspaper of reference comparing the country today to the oppressive and tyrannical society of George Orwell's 1984.
Making Out Like Bandits
On the radio one morning not long ago, I heard a probate judge say he has "to get on my knees and beg lawyers" to take the cases that come before his court.
"They are not getting rich on that any more than you get rich on jury duty," Brookfield Probate Judge Joseph Secola told WTIC 1080 on the Ray and Diane show.
Why, to listen to this, you'd think that nobody makes out like a bandit in the 19th-century realm of probate court.
This is hogwash.
While Judge Secola is correct in stating that lawyers who are appointed to represent poor people can make no more than $50 an hour working on the estates of the indigent, there is far more to this sordid picture.
It's why Chase T. Rogers, chief justice of the state supreme court, must select a reformer to succeed James Lawlor, who is being forced out of his job as administrator of probate court.
Probate is a place where even if you have prepared all the proper paper and legal work, your estate can still be slapped with thousands of dollars in court fees after you die. How else are they going to pay for the 117 courts and health insurance for the judges and their employees?
After all, Connecticut has more than 100 probate judges — some earning full benefits and $40,000 or $50,000 a year for part-time work — in a sprawling bureaucracy where probate courts are as common as your neighborhood Dunkin' Donuts.
Probate is a world where being a "court-appointed" lawyer in a case with even a meager estate can mean years of profitable legal work, including the chance to bill at hundreds of dollars an hour — if your client isn't deemed indigent. Court-appointed, by the way, means the judge tells you who your lawyer is.
In this Kafkaesque realm, this means the lawyers get paid, even when the judge makes a mistake and appoints a conservator and attorney when he has no business doing this. That happened in North Haven with Margot Claus, an elderly and sick German woman brought to Connecticut by a distant relative. Claus, now back home in Germany, was recently ordered to pay for a lawyer who should never have been appointed in the first place, who didn't even support her desire to return home.
In another recent case out of the Berlin court, Paul Czepiga, a lawyer who served as a court-appointed conservator in the long-running case of a Lucille Follacchio, has collected more than $77,000 in fees. There are additional pending bills for another $21,000, according to Legal Aid lawyers challenging Czepiga's fees.
Czepiga did not return a call for comment Monday. His fees include charges of $19 merely to fax letters and send an e-mail.
All of this is why it's so important that the next administrator of our probate system continue reforms begun by Judge Lawlor.
For starters, Judge Rogers should appoint a reform-minded judge who will demand more oversight of courts. There must be fewer courts that are open longer hours and which are run by judges trained as lawyers. Just like real courts.
"If you stop the gouging, you stop making this such a lucrative place for people to operate in," said Veronica Halpine, a Legal Aid lawyer in Hartford. "You have these little old ladies … they get their little tiny stash and it gets gobbled up. You are charging attorney's fees to manage a little old lady's life when she is under lock and key.
"People are making out like bandits. It's acceptable practice."
Under our largely independent probate system that many judges want to preserve, it's virtually impossible to track what is happening from one court to the next. How convenient.
"We don't know," said Lawlor, the soon-to-be ousted probate administrator, when I asked.
It's time we learn a lot more about what goes on behind closed doors in probate. It starts with appointing a new court administrator who is interested in more than preserving this centuries-old boys and girls club.

After almost 10 days of intentional starvation, the Courts finally acted! Was the victim of this cruel and unusual torture a hardened terrorist in the Guantanamo Prison Facility?
No! It was Janet Rivera, a 46 year-old mother who miraculously survived her savage treatment at the hands of a Fresno County Public Guardian.
Mrs. Rivera has been in a cognitively disabled state since she suffered a heart attack two years ago. She has been lovingly cared for by her husband, Jesus Rivera.
After Mr. Rivera experienced some medical problems of his own, Fresno County appointed a public guardian for Janet. Against the wishes of her entire family, including her husband, the public guardian ordered Janet to be deprived of food and water.
When we heard about her circumstance s, the Terri Schindler Schiavo Foundation immediately sprang into action. We helped the family find the right legal counsel and after days of hard work and persistence, the Court finally intervened and stopped this terrible travesty.

What makes these circumstances so important is that, unlike my sister Terri, where we were fighting a husband who didn’t care, Janet Rivera’s husband wanted her to live. So did her entire family.
To the public guardian, however, that didn’t make any difference. The guardian made the medical decision to dehydrate Janet to death in spite of the outcry from her family. We thank God the court removed the public guardian and spared Janet’s life, but the clear message here is chilling.
If the courts give the public guardian the right to make decisions against the expressed desires of the family, including the husband, then anyone who does not have an advanced legal directive can be killed by dehydration regardless of the wishes of the family.

Check out our latest posting of an elder abuse article from Wyoming. Randy Thomas, a consultant who trains law enforcement on domestic and elder abuse issues, says “It happens every day in numbers we don’t want to think about. Just look at the demographics. The public just doesn’t care.”
At EstateofDenial.com, we agree with this statement and believe it also applies to our focus area of Involuntary Redistribution of Assets (IRA) cases - those acts in which financial abuse occurs to the elderly as well as their families via trusts, wills and guardianships. People are quick to say “how awful,” but rarely do they want to hear more or learn how easily it can happen to them.
Steve Olmstead, director of the Medicaid Fraud Control Unit in the Wyoming Attorney General’s Office, said his office’s case load is increasing. “There is an underlying culture, ‘if we can get away with this then we can get away with that,’” Olmstead said. “If we go in for fraud, the next week we are investigating abuse.”

Dear Ray;
The issues in the Fernandez case should be headlined all over the news in this country and throughout the world. It is my prayer every day that it be happen.
The world needs to know the truth of what is happening to the elderly and vulnerable and the price we are all paying for those horrific misdeeds.For anyone to suggest to voice the truth of what is happening as "junk" is disgusting.
My brother was a victim. To have the opportunity to tell that story as I have on your website is not "junk" to our family. Nothing I say or do may ever get justice for my brother and closure for my family but at least when I stand at the grave of my brother in my heart I know it is standing for what is right, and NOBODY can ever take that away.
Thank you Ray, you will be forever in my heart and prayers. My deepest condolences for the heartache you and your family are being subjected to.

I hope they are reading what other victim's are saying. I want to expose all those attorney's, especially those who are wearing many "hats ".
I hired a lawyer who encouraged me, the client, to put my mother into the hands of a "Professional guardianship" corporation instead of fighting directly and swiftly with the court and present all pre need documents my mother had legally prepared (which named me her guardian if she should ever need it) I later found out that the lawyer I hired was representing the very guardianship company they told me to use. That is clearly a conflict of interest and when they had to go after their corporate client on my behalf they "dumped" me because they now admitted they had a conflict of interest (my legal fee to them were over $65,000.00).
I have recently found many elder lawyers who are handling many cases, all at the same time, for the courts(atty for the ward), cases representing professioanal guardians, and then the interested party, such as myself who was contesting the guardians fees and conduct. My experience and investigation led me to make a clear and loud warning. Lawyers are totally compromising the ward and family, These lawyers are "in bed" with guardianship professionals and they are helping to strip our parents not only of their civil rights but their ENTIRE estates, eaten up by their legal fees and encouraging more and unnecessary guardian fees.
So I say now , loud and clear to all those guardians and their participating attorneys: We know what you are doing and the party is OVER.
Ray, GOOD LUCK! Hopefully the judges in probate will take these cases and do what they are suppose to do: OVERSEE. The system has been negligent in allowing the financial and mental abuse perpetrated on the elderly and their family members who fight back. I give you permission to post this letter in protest of the crimes of these out of control professional guardians and their lawyers

For over a year now, I have been personally investigating a guardian here in illinois that has been abusing, neglecting and stealing from hundreds of eldery persons.She is politically connected and has close ties with with court system.I, along with anthor person have reported this person several times to the so called elder protection agency and they have done nothing.We also called the states attorney's office and all they did was give us some tips and tell us to call the police.
The police say this is a matter for the courts, meanwhile this woman continues to rape the elderly from their dignity and rob them of everthing they own.I was very pleased to see the FOX news do that report. I certainly hope they will do a story on what is going on in my area of illinois.This woman has literally been given the freedom and legal right to steal millions from hundreds of people with the total help from the entire court system here.I have had many sleepless nights over these horrendous crimes committed by this woman.
I have been threatened by her attorney to leave this alone etc..She has utilized almost every attorney in this county and received her glorious rubber stamp by the judges.We found out that she pays people finders fees to bring her these eldery people. She has literally picked them up off the street and has bragged about it.Since she has friends in high places, she obtains personal information about elderly people and seems to almost always choose her victims by the fact they have almost none or no living family, no children etc..
She also is in cahoots as you call it with several nursing homes. I could go on and on but this is your blog. I Just wanted to share alittle bit of my story and give you a HUGE thanks for continuing to make the public aware.Someone out ther has got to care about these elderly people, unfortunately for the elderly people that I am trying to protect, I have not found anyone yet.

My Name is Arthur Manthorne. I E-mailed you a while back about my wife Terri’s and my fight against abuse and legal and illegal theft within the confines of the system. You might remember that I sent you an update about Terri being taken from me and my losing conservitorship of the person. After this process it was an inevitable loss of her life orchestrated by a system of hospitals, health care families, family, lawyers, and money seeking individuals to go after the estate.
I am now alone and entrenched in the long drawn-out probate fight under which information and activity comes in small spurts and mostly troubling news. I have had several lawyers over the last 10 years that have taken money from me (and crucial evidence), made promises, and ultimately disappeared with my money and case evidence. Many times I have asked for and accounting of what they are doing with my money and all have not delivered on this promise. I would imagine that you have heard this story many, many times from others in my situation. It seems as though this is happening in slow motion and I am watching my life fall apart even further since the devastating loss of my wife Terri.
I am writing you to ask in your experiences with this troubling topic of Elder Abuse and Estate Stealing, is there any advice or direction as to who could help with my situation since the system has done nothing to aide in my fight. I fear that in a few more months that I will be out of my home and penniless with my enormous collection of abuse reports and filings which have fallen on deaf ears by a system that ignores its elderly and their cries for help.

EoD wants to know if communities condemn or embrace IRA practitioners (from the general public to potentially lawyers, accountants, caregivers, etc.) who set up shop in their neighborhoods. We also watch for public officials’ responses as some join the property poaching circle while others, though not active participants, quietly ensure that the “home team” suffers no setbacks with rightful heirs, out-of-town counsel or anyone else that might upset local “enrichment projects.” Our goal is to determine if these locales support the concept of property rights and will provide reasonable protection should residents or affiliated parties find such rights under siege or are your assets “up for grabs” the moment you die, become disabled or incapacitated? And a case currently playing out in a Williamson County district court will be a benchmark for area residents with regard to the practical stringency of their property rights.
Take a look at the ranking and let us know how the cities from your state match up. Are they a stronghold in protecting residents’ property or a poaching-by-probate-paradise?
