Drugged into Oblivion: The shocking Truth of How the Elderly are Treated

An elderly lady, pitifully frail, is seated in an armchair in the lounge of a care home, dozing fitfully.

Now just a little over six stone, she is a pale shadow of the vibrant woman she once was. What is going on inside her mind?

Is she lost in a dream of happier times, when she was young and full of life with an adored husband and young son - long ago days when it seemed impossible she would become old?

Or has this 85-year-old woman been doped up by the staff to keep her quiet, to make their lives easy - trapped in a perpetual state of confusion, destined to spend her final days in this twilight world of half-consciousness?

His mother told him she was being drugged and staff confirmed they were putting a sedative in her food.

"It is very convenient for staff at care homes to conceal drugs in the food and drink of residents, not for therapeutic problems but to make the residents easier to manage" he said.

Old people can be difficult and messy, and for many who work in care homes it is easier to dope them up and leave them to their own devices.
They receive no respect, their dignity is taken away from them, they are humiliated.

Only half of staff in care homes are required to be given training in caring for the elderly Most terrifying of all, they are given powerful sedatives which turn them into zombies and which experts say increase the chance of an early death.

No Elder , Should Have To Go Through This : Help Mollie

In 2003 Mollie Florkey’s son forced Mollie in the Hawthorn Glen Nursing Home in Middletown Ohio against her will. When she tried to leave the son had the medical staff put a straight jacket on Mollie and had them throw her in Lock Down. Mom was in her late 80’s. the treatment was too harsh! The son informed the Hawthorn Glen staff, ” If I tried to take Mollie home to call the police and have me arrested.” While at Hawthorn Glen Nursing Home, Mollie needed to go to the bathroom, she later told me, no one came to help her, she tried to get out of bed and fell flat on her face on a concrete floor. Mollie was rushed to ER.

While at Hawthorn Glen Nursing home Mollie received negligent care. Mollies health was in great jeopardy! Even the aides told me, “if Mollie wasn’t taken out of Hawthorn Glen she would soon die.” It was evident Mollie was going to die if I didn’t get her to a hospital. The son told the nurse Not to call 911 it would be too expensive. The son told the nurse, ” I could take Mollie to ER in my car.” Mollie could barely make it to my car. While at the Middletown Ohio, Hospital ER, the son walks in and ask the ER Doctor if it was really necessary for Mollie to be there. The Doctor informed the son, “Mollie had Pneumonia, Congestive Heart Failure, Bedsores and ulcerated legs. Mollie almost died.

In 2003 the Cincinnati Ombudsman Rep. for Hawthorn Glen checked Mollie’s files at Hawthorn Glen and found out the son had NO Power to hold Mollie Prisoner, Mollie could have gone home at any time. Ombudsman informed the son, “what he was doing was not legal and he could get in a lot of legal trouble. The son flashed his Law Enforcement credentials and the Hawthorn Glen staff allowed the son to get away with holding Mollie illegally. This gave the son time to have his attorney draw up P.O.A. documents giving him full power over Mollie without her knowledge. In order to keep the son out of legal trouble, the documents were dated January 8, 2002. Please keep in mind the Ombudsman Rep. that came into Hawthorn Glen Nursing Home from Cincinnati, Oh confirmed there were (No) January 8, 2002 documents when she reviewed Mollie’s file in (2003) If your going to hold a person PRISONER you better have Legal Documents on file. It was at this point, the son sold Mollie’s beloved home against her wishes.

The son refused to tell Mollie’s daughters how he dispersed her $110,000 from the sale of her home. For our own peace of mind we needed to know Mollie wasn’t taken advantage of. The son threw Mollie’s beloved dog out in zero degree weather, the dog later passed away. My sister and I didn’t have the funds to hire an attorney and the son got away with it. It is my strong opinion, the son used his Law enforcement credentials for his own personal motives and gain and got away with it.

In 2004 the son’s wife left him, for some unknown reason the son decides to release Mollie in my care however, he tells me, “I’m going to prove to you, you can’t take care of Mom, I’m going to (let ?) you take care of her .” For over three years I successfully took care of Mom, (Mollie). Mollie’s physical and mental condition improved greatly. It took over two years but I finally got her ulcerated legs healed by following doctors instructions.

June 3, 2007 the son forces Mollie BACK in ANOTHER nursing home, the Heartland Nursing Home in Hillsboro Ohio. The son threatened me, he told me,”if I challenge his authority, I would not like the results.” I immediately filed for Guardianship. I don’t know the Law, I thought if I was the guardian, I could stop the son from destroying Mollie’s life. The son forced Mollie against her will into the Heartland Nursing Home, he threw me out on the street, (it was an illegal eviction) I had just had emergency surgery, the son then closed down Mollie’s apartment. The son wanted to make sure there was no home for Mollie to return to, when we went to the guardianship hearing 11-14-07.

At the Heartland Nursing Home Mollie sat daily in her urine and feces, with her legs down. The social worker informed me, they were told by the son Not to listen to me, the Caregiver, who took care of all Mollie’s medical and personal needs for over three years.

The Heartland Nursing Home was informed verbally and in writing, it was Doctors orders to do monthly urine cultures, they refused. Mollie was rushed to ER, numerous times with infections and had to have blood transfusions. Mollie’s daughter in Chicago stated to me, “Mollie had Kidney Failure and almost died.”

At the 11-14-07 guardianship hearing the son had to lie, cheat and used his Law enforcement associates to obtain the guardianship. The son’s attorney is friends with the Probate Judge, they were once partners in the same law firm. It was obvious to All in the Court Room the Judges goal was to “Give” the guardianship to the son. It was a Kangaroo Court! Justice does not prevail in Hillsboro Ohio, the Legal System is Corrupt, it doesn’t matter if their Legal Buddy System devastates innocent lives! If your not in the Municipal Legal Whelm Justice will not be served.

The son never took care of Mollie a day in his life nor wanted to. The Judge refused to allow me to present my evidence of tape recordings where Mollie and I were harassed by the Heartland social Worker and medical staff. The Judge refused to acknowledge pictures of Mollie’s deteriorating appearance since being forced to stay at Heartland. The Judge refused to acknowledge Mollie’s legs were healed BEFORE forced into Heartland and now they were ulcerating due to the fact, Heartland refused to keep her legs elevated. I have the social worker on a tape recording stating, “they would Not make Mollie keep her legs elevated. It was explained per DOCTOR’S ORDERS, it wasn’t an option if she didn’t, Mollie would have serious medical problems which happened.

See PICTURES OF MOLLIE’S ABUSIVE NEGLECT. The Judge Refused to show any consideration for Mollie’s medical and personal needs. Mollie wasn’t even allowed in the Court Room. The Judge refused to acknowledge the son would rarely visit Mollie at her home and was inept to understand Mollie’s medical and personal needs, it was the reason Mollie suffered horrific “UNNECESSARY” pain and mental anguish at the Heartland Nursing Home.

The son knowingly and willingly defamed my character in order to obtain the guardianship. When I would visit Mollie at Heartland he left Orders for the Social Worker and medical staff to force me to leave without reason or just cause. If I didn’t they were told to call the police. The social worker did this in front of Mollie to purposely upset her to create false incident reports against my good name. Mollie asked the social worker, “Why, Why does my daughter have to leave, she’s done nothing wrong, we’re not bothering anyone.” The Social Worker replied while laughing, “because your son wants her to leave.” I recorded this conversation. One of Heartlands aides informed me, ” the son and the social worker were going to try and keep me out of Heartland, to force Mollie to submit to stay at Heartland and forget about returning home to live with me. NOTE: ( I have this conversation on tape.)

As long as I live I will never forget, as I was being forced to leave, my Mother, (Mollie) begging me not to leave her. Hearing my Mother, crying, calling to me, “Janie don’t leave me, take me with you. ” It was absolutely devastating to my soul! Before leaving Mom, I knelt down beside her and PROMISE Mom, ” I would never stop trying to FREE her, I would do my very Very Best to bring her back home to live with me.”

Mom was shaking and very upset, the Social Worker could have given my Mother a heart attack, they simply didn’t care. It was whatever the guardian wanted. Mollie’s medical and personal needs didn’t matter. The Heartland Nursing Home ignored the Residents Bill Of Rights 1987.

Mollie’s son had refused to allow me to see Mollie in over a year. To not allow a Mother to see her youngest child at the end of the Mother’s life is Evil! Mollie will be 91 years old July 9, 2009. Feb. 12, 2009 my son and I went into Heartland to see Mollie. Mollie’s son had told family members I could visit Mollie whenever I wanted. That was another Lie, I was told by the social Worker to GET OUT.” I refused to leave. My son convinced the social worker into letting me stay. Mollie was thrilled to see me, she wanted to know where I had been. Mollie said, ” for a long time I saw you everyday, then one day you were gone.” My heart broke because it was clear how much she missed me.

What the son did to Mollie was criminal! To rip Mollie from her home and a daughter that saved Mollie’s life. Mom knew she could always count on me to take care of her daily medical and personal needs. Mollie wasn’t dying, she wasn’t ill and didn’t need skilled care. It is shameful what the son has been allowed to do!

Ombudsman, the Ohio State Health Dept. KePro/Medicare/Medicaid, ALL the Ohio Elder Agencies, the Governor Of Ohio, our Ohio Senator’s Refused to step in and help a defenseless, vulnerable Elder. It’s only about reviewing medical files, appeasing the nursing home and the guardian. The Elder agencies didn’t like it because I questioned their method of investigating and I feel it made it much harder on Mollie. Since they didn’t like me Mom received negligent care. The nursing homes can document anything they want. The nursing homes are not going to document their negligence. It seems an ABUSIVE GUARDIAN HAS ALL THE RIGHTS. According to the Authorities, ” if the abuse isn’t happening while they’re at the Heartland Nursing Home, it isn’t happening.” What Kind Of Investigating Is That? The Authorities only talked to the Heartland nursing home and the son.

Heartland and the son are not going to Advocate Mollie’s Rights! The so called Authorities sealed Mollie Florkey’s miserable fate and refused to rescue her.

The Authorities stated, “they appreciated my comments and informed me, they would pass them along. That was over a year ago!

Pass them along to WHO? The SON and the HEARTLAND NURSING HOME ARE SLOWLY KILLING MY MOTHER, (MOLLIE FLORKEY) AND THEY’RE GETTING AWAY WITH IT! Heartland wants Mollie to have a slow, death, they don’t care if she suffers, because they want the funding from the STATE!. The son wants Mollie gone Now, in my opinion because he has a Huge Life Insurance Policy on her. It is my strong opinion, it may be the reason the son did not get proper medical care for Mollie. The last option would be the son needs a psychological evaluation. The son should be held accountable how he spent Mollie Florkey’s money, it’s all gone, whatever is left of Mollie’s possessions, is in the son’s pole barn. In the meantime I’m told, ” my comments will be passed long.”

A HUMAN LIFE IS AT STAKE HERE!

WHAT HAS HAPPENED TO OUR UNITED STATES OF AMERICA WHEN AN ELDERS LIFE IS SO INSIGNIFICANT?

OUR ELDERS HAVE GONE BEFORE US TO GIVE US A BETTER LIFE!

During World War II, Mollie Florkey worked on Airplanes that flew into combat over enemy territory. Mollie Florkey lost her husband at a very young age, when her children were babies. Mollie Florkey held down two jobs, came home every night, fixed a full coarse meal, did a load of laundry and cleaned the home. Only to start over the next day. That wasn’t easy! Life was hard on Mollie but Mollie Florkey has got “TRUE GRIT!” Mollie deserves to be Respected, receive the Best Medical care with kind, loving people caring for her!!!! Anyone that has cared for an Elder Understands it isn’t easy however, our Elders belong to us and we must step up and take care of them properly as our Elders did!

Columbus Ohio Ombudsman informed me, ” they found no fault with Heartland or the son. They refused to talk to outside witness’s that would confirm Mollie’s legs were ulcerating due to Heartland negligent care of not keeping her legs elevated. They refused to acknowledge pictures of Mollies deteriorating physical appearance, they refused to acknowledge my 31 incident reports of Mollie’s negligent care at heartland, they even refused to listen to the tape recordings of Mollie and I being harassed at Heartland. On July 26, 2007 the Ombudsman Director saw Mollie sitting in her urine and feces, saw Mollie’s legs ulcerating, she saw bleeding bedsores but said Heartland had corrected the problem. That was a lie, on Nov. 14, 2007 the day of the guardianship hearing, Mollie was rushed to ER with Congestive Heart Failure. Nine days later Mollie was found on the Heartland nursing home floor in a pool of blood with her head split open. At the Highland District Hospital in Hillsboro Ohio, the medical staff determined along with Mollie’s head busted open, Mollie had a full blown urinary track infection, a Hugh hole on her leg, her legs were ulcerating and bleeding bedsores.

At the 11-14-07 hearing, the Judge stated to “me” in Court, “after everything I’ve heard, then he paused and caught himself and said at the last hearing on August 8, 2007, (Now) you don’t get to see your Mother at all and that’s just what you get for all the trouble you caused.” The Judge then stated, ” the son is calling the shots and he will be the one who decides if and when you see your Mother.” NOTE: Nothing was said against my character at the Aug. 8, 2007 hearing or the Nov. 14, 2007 hearing. At the 11-14-07 hearing the son stated, “Jane takes good care of Mollie.” I’m a law abiding senior citizen, I’ve never been in trouble with the law. At the August 8, 2007 emergency hearing I informed the Court due to Heartland’s consistent poor care of Mollie sitting in her feces & urine daily, Mollie’s legs were never elevated, her legs were ulcerating, bleeding bedsores, Mollie not being bathed and always wearing someone Else’s clothes, I called the Ohio State Health Dept. to try and get Mollie proper medical attention. It was my Right to do so! My Mother was receiving abusive care. Because I called the Ohio State Health Dept. was the only reason the Judge made the statement, “all the trouble I caused” and used that lie as an excuse for the son to have time to bully Mollie and force her to submit to staying at Heartland. The Judge gave away his Court Room to the son on Nov. 14, 2007 and almost cost Mollie her life.

The Probate Judge informed me it wouldn’t do me any good to file an Appeal. I could not afford another attorney but filed an Appeal on my own. There were numerous mistakes and statements left out on my transcript by the Probate Judge’s, Court Reporter. I filed a motion for the court reporter to correct my transcript. The Judge denied my motion. I filed a motion for an audio of the guardianship hearing, the Judge denied my motion and of course I lost my appeal.

I have been up against Giants without any resources to help FREE Mollie. It should be clear to all now, the Legal Buddy System in Hillsboro Ohio put Mollie Florkey through an unneccessay, hellish transition of suffering needlessly at the end of her life where she almost has died due to negligent care of the son and the Heartland Nursing Home.

May 18, 2009 my son and I went back into Heartland to see Mollie. Again I was told to “Get Out.” Mollie started crying when she saw me. I wrapped my arms around her, Mom kept repeating my name, telling me how much she loves me. Mom was in bed, she has lost a lot of weight and she had an IV in her arm. Mom is very ill and needs to be in a hospital immediately! I read Mom her “Mother’s day card” that was two weeks over due. At the end I told Mom, “I Love you as far as the east is to the west! “ I asked Mom to “HOLD ON” that MIRACLES still happen. Mom promised me she would!

Please send HELP! Mom can’t hold on much longer! Mollie Florkey needs to be in a hospital to get proper care! The son must be removed as Mollie Florkey’s guardian! The Probate Judge must be removed from having any control over Mollie Florkey’s life. The Judge sentenced Mollie to an agonizing death.

Mollie Florkey must have the Right to return home to live with me where she will receive one on one care before it’s too late!

Please Help Save Mollie Florkey!

RIGHT HAND SO I CAN SWEAR HER IN. THE VICTIM WAS SWORN IN.

I have known Clara at least 15 years and saw her often several times a week, most times On August 2004 Clara suddenly disappeared without ever giving any indication she wanted to leave.
Attempts to contact or speak with Clara were blocked by Al Fernandez and Bill Hart, who did not allow me to talk with her .

This police report raises some very disturbing issues and exemplifies what happens when elder abuse is reported.

Mr Raul Fernandez NEVER EVER thinks that elder abuse is a civil matter, and words were put into my mouth, which brings up the question : Does a citizen when attempting to report elder abuse have a right to be accurately quoted in a police report?

In spite of numerous witness that gave sworn statements that Mr. Willam A Hart and Mr Adalberto J Fernandez Jr had overmedicated the elder while cashing her accounts and had held her in strict isolation, when the victim herself accompanied by her best friend Angela McClain tried to file a report (herself) she was ridiculed and her report trashed because "her hand was shaking."

Way too often as exemplied by this case attempting to report elder abuse or file reports can not only be demeaning for the elder and their families but a big waste of time as well.

Rob Them While They Are Down

JACKSONVILLE, Fla. -- The checks, credit cards and bank account of a 66-year-old woman were all cleaned out while she was hospitalized and in a coma. Now, authorities are searching for a culprit.

Police said someone stole thousands of dollars from the woman after she became ill with pneumonia and fell into a coma.

According to the police report, the incident happened when the ill woman checked into Baptist South Hospital last August. The report states, "she became very ill with pneumonia," and eventually "fell into a coma for approximately 30 days," and she didn't get out until the day after Christmas.

The report goes onto say, "during that time period from 8-21-08 until present, the victim's account has been debited to the amount of $12,466.14."

The victim has since moved into an assisted living facility in Orange Park. Channel 4 reporter Scott Johnson spoke with the woman by phone, but she asked not to be identified.

Police reports state the victim originally went into the hospital with her purse, but when she left months later the purse was gone.

Investigators were introduced to the case when a worker at the assisted living facility "advised the victim's bank account was being drained by someone. She and the victim presented numerous pages of bank charges that could not have been completed by the victim because she was in the hospital," according to the police report.

Police said they have been on the money trail and have talked to people who know the victim and may have had access to her personal belongings.

The officer handling the case said he is "attempting to obtain a warrant for the suspect's arrest."

If a person is arrested, he or she could face multiple fraud charges and a charge of exploitation of the elderly.

Ours Elders Deserve Better

The month of May is almost behind us, and with it the flowers and candy many of us showered on our mothers earlier in the month to mark Mother’s Day. But many older mothers are getting showered with attention of another kind – abuse.

Take the case of Ruth, an 89-year-old woman who was in fairly good health when she entered an Iowa nursing home for physical therapy in 2008. When she left to go home 25 days later, Ruth’s leg was rotting and consumed by gangrene. She died three months later. State and federal officials rightly called it neglect, and fined the nursing home $112,650.

25 years of congressional hearings on its devastating effects have produced no federal law to address the problem in a comprehensive manner, even though elder-battering has been called both a disgrace and a “burgeoning national scandal.”

When Greedy Operators Target Elders, Families Suffer

J.B. says that he and his grandmother have been victimized by financial abuse. Specifically, his grandmother is a victim of financial elder abuse and this abuse has had a severe impact on J's life, leaving him broke and homeless—living in an extended-stay hotel with the help of a non-profit organization and relying on doctors to provide him with pro bono medical care.
"I can't access my own money [which is in an insurance policy], but having that money in my name is blocking me from getting benefits and help with an attorney," J says. "Would you believe that a forgery by one person would land someone else homeless on the street?

"J says the situation started when his grandmother decided to buy him and his brother an insurance policy on her life.

"The intent was to give us some of her estate," J says. "But, she was taken advantage of by her insurance agent. She bought a quarter of a million dollar policy death benefit on her life.

"In order to get the most commission, the agent had to sell the policy as an estate-planning tool, but Grandma didn't have a big enough estate to need the benefits he was selling.

"The insurance agent duped her, took advantage of her and manipulated her, but he didn't take her money, he took ours because she gifted it to us. The insurance agent was scamming an elder. His commission was $22,000 out of $144,000 that was put in.

"We wrote a joint letter [giving their grandmother permission to borrow the money] and we get a letter back saying that the signatures on the letter don't match the signatures on file.

How could it not match when we didn't sign anything? I looked at my grandmother's contract and our signatures aren't on the contract. The company said that my brother and I are owners and are in complete control of the policy. "I didn't know the policy was fraudulent, I was just suspicious."

In the meantime, J continued to struggle with his illness and ran out of money. His employment until he was sick consisted of being trained as a surgeon, which does not count towards SSI benefits, so J applied for disability and multiple doctors stated how severe his illness was. Unfortunately, the life insurance policy J's grandmother took out for him and his brother counted against him. Because J is listed as an owner of the policy, he does not qualify for disability benefits.

"I have nothing. I have been living in my car and my doctor continues to treat me pro bono, even to this day, and helps me get compassionate fills from the pharmacy. I was first denied SSDI in March 2007. A year went by with me fighting the insurance company and they are still ignoring the forgeries. Then, I find out that the policy is dwindling in assets and that the benefits are nothing if she [J's grandmother] survives past a certain age. She bought this as a whole life policy.

"There is $25,000 still in the policy and half is mine, but I have no access because it is jointly owned with my brother. The company knows that the signature was forged because they admit that whoever signed my name also signed my brother's. I was in Thailand when I supposedly signed those papers. So, I have no access to the money, the cash value in the policy is dwindling, and, because I own that life insurance policy—rather than being the beneficiary—I don't qualify for benefits.

"This all started with an insurance agent who wanted a big, fat commission. The insurance company assures my grandmother that when she dies we will get the death benefit—but they don't say we will get $250,000, just that we will get the death benefit. Illegal Immigrant Savagely Beats and Blind Older Woman

A man has been arrested for allegedly beating and blinding a 78-year-old widow inside her Daly City home after she surprised him during a robbery attempt, police said today.

Jose Perez-Gonzalez, 29, was arrested Nov. 26 by Mexican authorities in his hometown of Guadalajara. He has been charged by San Mateo County prosecutors with attempted murder, attempted armed robbery, burglary, mayhem and elder abuse.

On Jan. 12, Perez-Gonzalez, an illegal immigrant living in South San Francisco, was driven to the victim's home in the Serramonte neighborhood by Juan Cuellar, 37, of Daly City, said police Lt. Jay Morena.
As Cuellar waited in his car, Perez-Gonzalez pried open a rear sliding-glass door, police said. When the woman confronted him, Perez-Gonzalez allegedly beat her in the face with his metal pry bar, an attack that left her blind.

The assailant fled with Cuellar, authorities said. Cuellar was later arrested and is being held on a federal immigration violation for being in the United States illegally from El Salvador.

Mother of Slain Tot Seeks Help.- Finds None

ROSEDALE, Alta. — The mother of a tot slain by his father in a murder-suicide says she had been stalked by the man for months and fled her home in fear.

Meara McIntosh, 27, sat on a deck outside that house in Rosedale, Alta., on Wednesday saying she had left because she felt it was the only way to save her son Colton from harm.

"I left here because I was terrified to be in my own home," she said.

On Sunday, her worst fear was realized when police found the three-year-old dead in a house in nearby Drumheller. He had been killed by his father, Richard Saunders, who was found dead at his side.McIntosh said a court order forced her to hand Colton over to Saunders for the weekend despite her fears.

"I knew, statistically, it was the most dangerous time and had no intention of letting him see Colton again."

She said she is particularly distraught because "I forgot to say goodbye."
"But baby boy didn’t. He always said goodbye. He said goodbye over his shoulder and went bouncing off."

McIntosh said she left her husband because of his drug use and late nights when Colton was 10 months old.She moved from Fort McMurray where they were living to Drumheller, but Saunders soon followed to try to rekindle the relationship, she said. A custody dispute unfolded."Then the stalking started."

McIntosh said it began with suspicious footprints in the snow outside her home, vandalism and slashed car tires. She got a restraining order but after it expired she sought help — only to find none.

She said police threatened to arrest her "for making false complaints," while a social worker tried to claim she was an unfit mother. Some people in the community simply didn’t believe her.

When disputed territory(Family Estates ) this gives courts the right to intervene and invade (family sovereignty) install Guardians (peacekeepers) who end up plundering at will and ultimately by charging huge fees end with the bulk of the Estate to the chagrin of family members who initially trusted the courts but who now are caught like 'deer in the headlights'.

Woman Charged in Mother's Death

Jackson County Prosecutors charged a Lee’s Summit woman Tuesday in connection with the death of the woman’s mother.

Glenda I. Grimes, 55, of Lee’s Summit was charged with second-degree murder, second-degree domestic assault and elder abuse.

According to court documents, Grimes’ mother died on the evening of Feb. 20 while Grimes was out at dinner. In addition to several severe bed sores, the victim’s leg was broken but had only been wrapped in tape.

At no time did Stevens receive medical treatment for her broken leg,
Her report indicated the victim suffered 25 fractures, including multiple rib fractures dating from less than two weeks old to more than a month old.

Bond on Grimes has been set at $100,000/10 percent or secured. Her next court date will be June 25 at 1:30 at the Independence Courthouse Annex.

I think I know my father Dr. Fernandez well enough to know he would have wanted his social sec to benefit his wife by allowing her to stay in her home with ALL her bills paid, including the needs of her caregivers.

Man Keeping Grandmother in "Unlivable" Conditions

A 28-year-old Taft man has been charged with felony elder abuse after Kern County Sheriff's deputies found his 81-year-old grandmother living in conditions that were described by investigators as filthy and extremely unhealthful.The victim was hospitalized when deputies went to the home on the 600 block of D Street on March 18.Sgt. Martin Downs said deputies found the victim confined to a reclining chair surrounded by soiled disposable diapers in a house that he described as “unlivable.”

The woman was unable to walk because of her medical condition, and was immediately taken to Kern Medical Center for treatment.“The home was filthy, littered with trash, dirty dishes, dirty clothes and infested with cockroaches,” Downs said.The grandson, Scott Aaron Moore, was arrested Wednesday by deputies and booked into the Taft jail on the one felony elder abuse count.

He is currently free on bail.

Elderly KC Woman Found in Own Waste Dies

An 85-year-old woman who had been allowed to lie in her own waste for several years died at a hospital this morning.

Police arrested a man and two women last Thursday after finding Hazel L. Byes in her bed in the 5700 block of Forest Avenue. An ambulance took Byes to a hospital for treatment.

Police said today they were presenting a case to prosecutors today for possible criminal charges.
According to a police report, firefighters had been called to help transfer Byes, described as “bedridden and overweight,” to a hospital. An officer who responded noted a strong odor of human waste when he entered the home. The source became clear when he saw Byes’ bed, the officer wrote in his report.

Elder Woman Allowed to Lie in Her own Waste for Years.- No Charges Filed!

Kansas City police arrested three people Thursday during an elder-abuse investigation in which an elderly woman had been allowed to lie in her own waste for several years.

Police spokesman Rich Lockhart said firefighters called police when they answered a call to the home of Hazel L. Byes, 85, in the 5700 block of Forest Avenue Thursday evening.

“They reported that her condition was potentially life-threatening as a result of not being moved and lying in her own waste for several years,” Lockhart said.

No charges have yet been filed against those arrested, a 46-year-old man and two women, ages 47 and 50, all of whom Lockhart described as family members.

According to a police report from the scene, firefighters had been called to help transfer Byes, described as “bedridden and overweight,” to a hospital.

Police Officer Charles J. Miller wrote that he noticed a strong odor of human waste when he entered the home. The source became clear when he saw Byes’ bed.

“I observed a big indentation covered in what appeared to be dry human feces in the middle of the victims’ bed,” Miller wrote.

Police called in the domestic violence unit to continue the investigation and Byes was taken to an area hospital for treatment, according to the report.

THIS INVESTIGATOR DID NOT OBSERVE ANY SIGNS OF PHYSICAL ABUSE OF MRS. CLARA FERNANDEZ AT THE TIME OF THIS INTERVIEW. MRS. CLARA FERNANDEZ APPEARED TO BE HAPPY BEING IN HER HOUSE AT 15 WEST CYPRESS, IDENTIFYING THAT SHE AND HER HUSBAND BUILT THIS HOUSE, AND THAT IT HAS MANY MEMORIES.

in the same report a statement was taken from Clara by the officer:

"I SPOKE WITH MRS. FERNANDEZ, WHO STATED HER SON, A. FERNANDEZ, WAS A BAD PERSON AND HE HAD KEPT HER WITH HIM FOR ALMOST AN ENTIRE YEAR AGAINST HER WILL."

There are still friends of Dr. Fernandez and Clara who knew them well, among these are judges,cops and neighbors who knew them well and knew that they were "The perfect couple".

It took a year for Dr. Fernandez to see her wife again at a substantial legal cost involving many attorneys over several counties for these two judges to come to the conclusion that this couple belonged together, the stress created to this couple ( Documented here and Here) caused the premature and unnecessary death of Dr, Fernandez.





Dr. Fernandez's health is quite delicate and should avoid all stressful or confrontational situation"Dr.Elias J.Gerth,MD,FCCM 10-26-2004.

Would you consider dragging Dr. Fernandez through a long drawn out and expensive legal process throughout 4 separate counties, alleging that Mrs. Fernandez does not own her home or live in Monroe County with her husband, stressful.......

It is a well known fact that older people do not transplant well, especially older couples that have been together a long time should not be separated unless there is a good reason the failure to take appropriate action to avoid serious harm to Mrs Fernandez when all agencies that could help were forewarned of the pending danger in taking Mrs Fernandez out of the safety of her especially equipped handicapped home to become a victim of neglect and abuse along with the legal expense and the stress created caused by the forced separation . When Clara was recovered on Agust 5th 2005 the first words out of her mouth were " I was always looking for way to escape."

The legal action that followed precipitated the death of Dr. Fernandez and the spending of all the money left aside for their old age on legal procedures put an end to their golden years together and is a crime that should be carefully analyzed to make sure that the safeguards in place to protect our elders are adequate and does not leave them wide open to predatory practices and years of legal battles, endless court hearings and the wholesale destruction of families.

Now can you imagine those victims that don't have the the money to pay the legal ransom required to get their loved ones back? or to try to get their property back ? What kind of justice can they expect for their loved ones?

Teens Murder Elderly Woman for Petty Theft

SAN BERNARDINO - Murder charges were filed Tuesday against two San Bernardino teens held in connection with the fatal beating of an 87-year-old woman in her mobile home.

Del' Andrae was in a coma for nearly three weeks after being struck repeatedly on the head with hammers. The one-time countess had met Garcia's family through her church. The father sent the boy to pull weeds in her vegetable garden a few weeks before the attack, her friends said.

"It's just a hideous crime," San Bernardino police Lt. Scott Paterson said Tuesday, echoing previous comments from prosecutors and Del' Andrae's friends. "She was trying to help them out."

State Protective Services For Adults Faces Cuts-One Third API Jobs Eliminated

The elderly woman had lived in an antiques-filled Atlanta townhouse and had amassed more than $1 million in assets.

By the time Susan Geoffrey met her, the townhouse was gone, and the woman, in her 80s, had only a fraction of her money left.

A caregiver, who had power of attorney, had spent the woman's money at a rate of up to $60,000 a month, says Geoffrey, an adult protection worker who investigated the case for the state. Geoffrey helped stop the years-long scam.

But under a budget plan proposed by Gov. Sonny Perdue, up to one-third of the adult protective services jobs — about 53 — may be eliminated. The state Department of Human Resources, which runs the program, cites a loss of $4.1 million in federal funds as the reason for the budget crunch.

Physical abuse of seniors can include beatings, cigarette burns and broken bones. Some people are deprived of food and needed medications.

"It certainly did shock me," Geoffrey said of her experience as an adult protective worker. "I couldn't believe that people could treat other people, especially family, that badly."
