Over the years, a shift in law enforcement priorities, as well as an increase in general awareness, has made most officers familiar with the concepts of spousal abuse and child abuse. Still, the term elder abuse raises questions among even the most seasoned law enforcement officers. From physical, emotional, or sexual abuse to financial exploitation, approximately 818,000 elderly individuals are victimized annually.

Furthermore, experts estimate that only 1 in 10 cases of elder abuse gets reported.(1) Many elderly citizens must contend with a variety of health problems that limit their physical or mental functioning. Some become bedridden and cut off from normal contact with the rest of the world. At the same time, mental limitations leave many older citizens highly vulnerable to various forms of abuse.

FBI Warns About Internet Fraud Schemes


The FBI is warning the public about an ongoing scheme involving jury service. Please be aware that individuals identifying themselves as U.S. court employees have been contacting citizens by phone and advising them that they have been selected for jury duty. These individuals ask citizens to verify names and social security numbers and then ask for their credit card numbers. If the request is refused, citizens are then threatened with fines. Details

Four arrested in ID theft, elder abuse scheme

Fresno,California,USA Authorities are holding a news conference this afternoon in Fresno to announce the arrests of four people in connection with an investigation involving dozens of cases of identity theft and elder abuse.

Taking part in the news conference are Fresno Police Chief Jerry Dyer, Frank Ducar, a U.S. Postal Service inspector team leader, John Savrnoch, an assistant Fresno County district attorney, and representatives from the Fresno County Sheriff's Department's elder abuse unit.

All of the arrests reportedly were made Thursday. Two of the suspects are described as Bulldog gang members.

If you've ever spent time just hanging around a big city's street, you may have noticed an interesting phenomenon: the car door handle flipper. He's the dude sauntering alongside a row of parked cars nonchalantly trying each door handle to see if it opens. He's looking for that promotion from urban nuisance to car thief. He's in no hurry and he doesn't discriminate between the cars. This is how computer hackers work as they search for access to someone's home computer.

Like the prospective car thief, hackers randomly and systematically scan machines on a network, like Road Runner's or Earthlink's for example, looking for a way in. The way in is one of the 65,535 ports that exist as a part of any machine's IP address.

If nothing is holding these access points closed, the hacker knocks until a port answers. Nothing personal, the whole thing is automated, and the hacker is probably off doing his laundry or playing UNO with his little brother while his port-scanning script runs wild over the network you happen to be using.

“Lately, a number of worms and virus infections have, among other things, ‘listened' on a particular port, so that when scanned, the infected computer is able to be controlled remotely. Computers that have been hacked this way are said to have a ‘back door,' and are used to send spam and conduct internet attacks, among other things. What this means is that the computer is completely unsecured and readable from across the net,” explains Rob Noel , Client Services Manager for OASIS. It is frightening to think that your machine might be used for nefarious purposes, isn't it?

My Story( In Clara's and A.J. Fernandez behalf)

Clara and Dr. Fernandez fell in love with Orlando, they loved the amusement Parks, the Flea Markets, they liked everything about Orlando, to them to build a House in Orlando was a dream come true.

When Disney started up , I worked as a Project Manager for Bay Lake Ranches and as part of my compensation package was a lot in the Bay Lake Ranches Sub Division which was given to me at a deeply discounted price.

Clara to me represented a pillar of stability and I titled the Lot under her name which was to be later transferred to her Trust for safekeeping and estate planning purposes..

The last thing to cross my mind was that at a very late age Clara would develop Dementia and Alzheimer's and would become easy prey for those that would take advantage of her and trick Clara into signing away her Trust and everything in it.



Here Clara is seen walking under her own power on June 2004 , and deciding where the driveway to the dream that was not to be , in her new home. Little did she know that two (2) months later she would be taken from her home and drugged and left alone in a motel room to fall and become incapacitated, thus losing all her rights as a citizen with a voice and becoming a "Ward of the Estate " who would decide where she is to live, and whether she is to have cable TV and have a say over all the decisions over her care and finances.

Little did she suspect and that all her dreams and that of her husband would be snuffed in the land of the free in a single careless act of negligence by a Social worker/estranged family member who would be protected by the estate at all costs in spite of the horrendous acts of Elder abuse and Elder Financial Abuse committed by him and others on Clara and Dr. Fernandez. Acts that would make the life of Dr. Fernandez a living hell, an elder who never did understand why his wife of 57 years was forcibly taken from his side in his twilight years when he needed her the most.

With the likely scenario of home and lot sold to pay for legal fees for the ensuing legal battle that would last for years and ultimately take her out of her own home and into a nursing home. So that her home can be sold to the highest bidder and the money distributed in legal fees,court costs and the like.

The day was April 24, 2004 when Clara applied for a building permit she could hardly contain herself and insisted in talking to the building officials personally about her new Home Estate in Orlando.


The rest of the story is well known to readers of E.A. hardly two months later Clara was abducted and the permit to her new home Estate expired , thousands upon thousands of dollars were lost in Architectural fees, Engineering fees, Permit,Septic,Well,Soil , revisions (4) drawings,site plans.

Of course none of this mattered to the people who held Clara incommunicado and drugged, the people who emptied her Trust, and re wrote her will to benefit them, the people who sold her jewelry on the Internet and left this 87 year old infirm elder alone in un familiar surroundings to suffer serious injuries and forever lose sight of her dreams.

During the hearing on 8-29-07 a poor attempt was made by the Guardian's attorneys who wanted to dis credit me at all costs. I felt belittled because I had voiced my father and mother wishes that their labor be rewarded in leaving a Estate behind as stated in their estate planning documents for their grandchildren and great grandchildren to always have a place to call home , and because an offer to sell the Key West Home under very generous terms was entertained in view of the move to Orlando. I felt malicious belittlement, I was made to appear dis honest , with questioning along the lines of " You appear to have such values to want to preserve the estate home, yet you wanted to sell it to enrich yourself".

When I tried to explain why we had tried to sell the Key West home, and when I tried to explain my parents dreams, which were now my dreams. - I was cut off .

.....because the authorities threats the victims as the “criminal perpetrators” and protects the perpetrators instead of victims? Because our justice system protects them no matter how horrible and barbaric their citizens are .....

Have we become like them? this is my parents story who came from foreign shores to build a dream, they lived the American Dream, but they sure did not deserve the nightmare, the nightmare and the feeding frenzy that awaited them in their old age.

...the attorneys might prevent me from telling their story in the courtroom , so that they might never know of their sacrifices, their suffering, but this is the courtroom of public opinion and I will tell it here, .. The world must know so that their sacrifice will not wasted, the sacrifice of two people who gave it their all for their country but received very little help and support in return.

How many of these messages do you have to get out to screw some old people out of their savings ? 1 out of 400 perhaps, maybe if you buy the mailing list InfoUSA advertised lists of “Elderly Opportunity Seekers,” 3.3 million older people “looking for ways to make money,” and “Suffering Seniors,” 4.7 million people with cancer or Alzheimer’s disease. “Oldies but Goodies” contained 500,000 gamblers over 55 years old, for 8.5 cents apiece. One list said: “These people are gullible. They want to believe that their luck can change.”

Perhaps if you try the List Suffering Seniors,” 4.7 million people with cancer or Alzheimer’s disease your odds will be better and perhaps one day when Elder Financial Abuse isn't such a popular and profitable undertaking our politicians will pass laws to put scum like you in Jail.

Darned,..this stuff is happening to families is so wrong,..I feel sorry for the woman,..and I am seeing that she is reaching out for your help.

Sad that people are so greedy,..sad that we don't see the warning signs before this crap happens!
In your case Ray, it was "writing on the wall",..but you couldn't imagine such evil in your brother,. you have a way of only seeing the good in people. In a way that is a good thing,..in another, it certainly was not.

I have always been able to read people , I started to read into people for my own protection, and I haven't had any really bad problems with anyone. I saw the problem coming down the line for you ,..but you had to find out for yourself.

Yes find out for myself I did, you were right a lot of people warned me, and I wrote it off , even when he would visit late at night and stay up all night going through the file cabinets gathering account numbers, information he could use later, to carry out his plans .

And I still did not read the 'writing on the wall'

After he took Clara , and alarms bells went off, even then we would say, "He is her son, he is not going to let anything Bad happen to her!"

Surprise, Surprise, Surprise not 3 months went by before Clara was totally incapacitated and fighting for her life in a string of hospitals and nursing homes.
This totally devastated A.J. Fernandez, Clara's husband of 58 years , who died shortly thereafter from the stress off the situation.

Life's Bad Breaks for Clara and Dr. Fernandez

Once the New POA was in place a choke hold was places on Clara and Dr.'s Fernandez finances , it was vicious, it cut medications ,utilities,mail,insurance...read on....


Clara's insurance lapsed when a mail stop was placed by person(s) using Clara's identity filed a Mail Stop and the mail was held up for an extended period of time causing essential services to be cancelled.





Clara who here to had A-1 credit . A power of attorney was filed against her account, displacing the legitimate heirs, who were un able to make any payments on her accounts that went into collections.

Note. Because of privacy laws the legitimate heirs were totally cut off, unable to even talk to the phone company about a payment plan, the phone number that Dr.Fernandez and Clara had for 30 years (305) 294-6126 was the first thing to go then their insurance, followed by their credit,
the devastation was total.





Utilities were cut off and an effort to starve Dr. Fernandez out of the his house ensued.







The caregivers insurance coverage who Clara always made sure they had proper health insurance coverage, was one of the first casualties.

Dr. Fernandez held out courageously, with no roof on the house (Hurricane Wilma) in the rain and with utilities,medication flow cut off (See complaint FDA) which alleged that he did not have prescriptions. Dr. Fernandez held out for almost a year from the time his wife was taken, he died due to the stress of the situation on January 9, 2005.

The Abduction ! August 20, 2004


According to Medical Records this stranger was responsible for Moving Clara's medical Records. Also according to my investigation of Clara's financial records he is also responsible for the Liquidation of her Bond Accounts to the tune of $65,000.00

Clara is seen forced to pose with, or maybe she joined a motorcycle club, we are impressed fellows! Do you do this with the other elders too ? Just curious.


Here Clara is seen with the wine flowing freely and being pushed into a situation where she doesn't belong, as her husband Dr. Fernandez is dying a slow death at home not knowing her where abouts and being refused his every effort to see her!


Here We see Clara again, wine flowing, medications on hand at a meeting of the Widows Quitclaim Deed Club.


Here's Clara on the Lam! Shortly after she was abducted, Good Try fellows but we recognize her anywhere. We would still like to know if you can please return her jewelry, Oh. I almost forgot I refused to sign the Mediation agreement, giving you rights you are not entitled to and rewarding you for your errant/bad behavior and legitimising your disgusting 'alledged' criminal behavior.

So you won't return to Clara the Jewelry or the money you stole!


After Clara was taken, she was left alone for long hours at a time leading to a serious fall in a Hotel Room! Your attorney, who is very good at delaying this case so it will not make it to Trial while Clara's alive and the whole legal system that's financially bleeding Clara dry calls it an accident! This was NO accident. It is documented that Clara was loaded with drugs and left alone.

And would anybody mind looking up the definition of Elder Abuse. What was Clara doing in a Hotel Room alone! With her handicapped house and 24/7 excellent health care that she is receiving?

Sure ! You justified the drugs because you say they were prescribed by a Dr. Yes , a Doctor that was not familiar with her health history, and prior history of a proness to falls .... and we know you farmed out the prescriptions, from different Doctors and drugstores.

Several people in my circle of friends believe this doctor(s) should be investigated for giving elders who has been diagnosed as prone to falls, and prohibited this king of drug(Dr. Joseph Scarlett ) dosis of tranquilizers that are excessive for a person her age.

Enjoy your legal immunity that your social worker status has given you while you can .


You can fool some of the people some of the time, but you can't fool all the people all of the time.

Sooner or later Senator Herb Kohl (D-WI), ChairmanSenate Special Committee on Aging who is a reader of E.A. or some other influential Elder Abuse Advocate is going to call for a REAL investigation of this horrific case of intentional neglect of an elder person, misappropriation or misuse of funds of an elder person by means of deception and embezzlement by misuse of a fiduciary relationship.

And your diplomatic immunity is going to end once and for all .



Clara was taken from her home on August 20, 2005 and in the following 12 months she would endure being bounced around "Like a puppet on a string." District Judge Von Hoff

Clara would endure 5 address changes, She would be left alone in 3 nursing homes, her care would be farmed out to a 'alleged' homeless person who gave her a 'real and non alledged' Sexually trasmitted Disease (STD), Clara was told her husband was dead, that her caregivers had abandoned her and some much other stuff that will leave some for whenever a serious investigation into this case is finally ordered by someone that cares.

Something Needs to be Done to Protect My Grandmother !

Something needs to be done to protect our elderly from abuse/exploitation. A few years ago, my grandmother was approached by her son with some papers. My grandmother, who has Alzheimer's and doesn’t read or speak English, unknowingly signed a Quit Claim Deed handing over her house to a corporation whose President, Vice-President, and Secretary are my uncle’s three children.

Of course, no one in the family was aware of this until my mother tried looking for cheaper house insurance for my grandparents when she learned that my grandmother and grandfather no longer owned the house. Since then, this has been a never ending battle in court.

Elder Affairs was contacted many years ago. They sent a case manager out to the house, yet nothing was done. My mother paid over $10,000 dollars to one attorney who didn’t do anything to resolve this case. This case was referred to Comprehensive Care who hasn’t done anything to settle this case. Worse yet, they recently asked the judge that they no longer want to represent my grandmother because they are having a difficult time reaching my uncle and his attorney.

How could this be happening? This has been in and out of court since 9/22/04. My grandmother is 90 years old and her memory has deteriorated greatly. What recourse do we have? What can we do when our legal system seems to be failing us? When my mom went to court yesterday, the judge did not have the case file, no longer remembered the case, and was pleased to hear that my uncle doesn’t mind my grandmother living in the house, “her own home!” Why hasn’t anyone been able to void the quick claim deed?

I hope that you will continue to write about this problem. We need to fight to protect our elderly from abuse/exploitation from strangers, family members, and the legal system. I have contacted my state representatives, and I will continue to write until something gets done.

I really feel for what you are going through, this is one of those things that is supposed to happen to 'other people' until you become a victim yourself. Elder Financial Abuse is being called the Crime of the 21st Century.

I am very well acquainted with the never ending battles in court Defense Lawyers Often Try to Delay Trial of Elder Abuse and Exploitation cases until the Victim is too Disabled to Testify, Experts Say

The reason you haven't been able to reverse the Quit Claim Deed gained by trickery is because you haven't paid the Legal Ramson in the way of Legal fees. $100,000.00 seems to be the going number for most of these type of cases that we at E.A. have heard about.

Elder abuse justice is for the rich! 85% to 96% of Elder Financial Abuse goes un reported , perhaps now you know why!

When Clara started getting Dementia, she wanted to sign the house,CD's, assets over to us, however we are old fashioned and we told her "No all those assets are yours until you die, you might need them, we are not here for that." As her mental abilities declined a group of opportunists saw the door swing wide enough for them to get control and vacate her trust of anything of value, including some unique personal jewelry, which Clara was wearing on the day she was taken and is un accounted for.

So until laws are changed to benefit the victims and their families, all I can say is when you notice someone in your family starting to get old and senile, you better transfer all their assets over 'pronto' because once the 'opportunists' get their foot through the door, you will never be able to shake them. After all they have nothing to lose and everything to gain, so if you end up spending all of your grandmother's assets in legal fees, that just fine with them as they have a 'Scorched Earth' mentality.

It seems that when it comes to our elders that possession is 9/10ths of the law, once the opportunists,elder abusers,lowlifes, what ever you want to call them get their greedy hands on your immediate family assets all they have to do to get off is accuse you of the same thing you are accusing them, this is usually good enough to throw up a smokescreen and confuse the investigators.

"Individuals 65 and older control over 70 percent of the nation's wealth," As Willie Sutton is famously known to have said, when explaining why he robbed banks: "That’s where the money is." It seems that a number of individuals, and some organized gangs, have realized that many single elderly persons have that in common with banks: they have money, and it is all too often available for the taking.As baby boomers begin to retire and their parents pass away, Americans are about to witness the largest transfer of wealth in the nation's history.

I suggest that you keep writing your congressman, although you are highly unlikely to get any sympathy from people who have never experienced Elder Abuse firsthand.
If you press the issue like we have , they are likely to tell you that your grandmother has the right to give her house to whomever she wants, and give the old 'shoulder shrug'.

The way (some) authorities thinks your grandmother is old and she is probably going to die anyways, what does she need a house, money for ? It's very kind that your uncle will allow her to live in her house, even the judge told you so .

Well my brother wasn't so kind and he put my mother, Clara Fernandez in 3 nursing homes totaling 5 addresses changes shortly after he executed a series of Quit Claim Deeds under similarly questionable circumstances .

Emergency Medicare Transport was used to keep Clara secreted from her family and during one of those shuffles and under what Dr. J. Aguinaga M.D. calls, " A dosis in excess of what is common for a person her age" , she was left alone in a hotel room, fell and struck her head
she was taken to Baptist Hospital for Emergency Neurosurgery and had been in wheelchair ever since , this incident triggered a downward spiral leading to loss of independence, a serious complicating illness and further falls.

Those of us who have experienced Elder Abuse first hand have a sneaking suspicion that
Who Are Public Agency Investigators Protecting: The Neglected Elder Or The Perpetrator of The Neglect?

Sorry I don't have better news for you, or the thousands of elders that are abused on a daily basis in Massachusetts alone , 43 new incidents of alleged elder abuse are reported each day. , the outlook for victims of elder abuse is pretty grim until people say , enough is enough and start demanding reform ,we as an aging population face an uphill battle.

Dr. Fernandez Dies : Stress took Ultimate Toll on Senior



Sadly this story is being repeated way too many times only the names change , the story of abuse remains the same.

Dr. A.J. Fernandez loved Clara, whom he met in Cuba on 1945 and married her a year later in Boston , Ma. Clara first caught his eye when he rode by on a bicycle and later they would meet again at the bank where Clara's father was the administrator and A.J. stopped by to get a loan to pay for his tuition for medical school , Clara recalls, "he was really cute, shy and had beautiful blues eyes..

"What Dr. Fernandez didn't know when he met Clara was that in the Golden Years of his life they would be separated by a greedy relative and that they both would become victims in a tenacious scam orchestrated from Winter Haven, Florida and that the same Law Enforcement Agencies, the The Sheriff's Office , State Attorneys Office that showered him with plaques, honors just a few years earlier would now turn a deaf ear when Dr. A.J. Fernandez asked for their help in seeking his wife Clara's return.

"Some children try to acquire their parents' money before they die and beat their siblings to it," said Yvonne Zardani, secretary of the Queensland branch of the Australian Pensioners and Superannaunts League. "They use their parents to get everything they can get." Sons and daughters take money, promising to care for their parents and then abandon them.

Fernandez would endure the final year of his life under crippling stress, siting on the edge of his chair, staring at the front door , wondering why his wife had be taken from his side , his family believes contributed to the deterioration in his health and led to his death three days after Judge Richard Payne, ascertained in a 'Motion to Determine Residency' that Clara's place was by her husband in their home in Key West Florida.

It's not the total amount alleged to have been taken out of Clara's Trust or the Real Estate properties and Jewelry that disappeared that makes this case stand out. It's the impact on the victims.

It started on August 21st in 2004 , when Clara's oldest son, Adalbertol(Al) Fernandez , Jr. a social worker , and another man William(Bill) A. Hart came up with the idea to take the ailing elder who had been diagnosed with Dementia, High blood Pressure, Osteoporosis , and was taking medications for Alzheimer's to Winter Haven, Florida.

Under unbearable anxiety....Dr. Fernandez encountered health problems and refused to eat until he saw his wife, and had to be given steroids shots, in order to induce him to eat and keep him alive.

He started coping with bouts of depression and had to be hospitalized several times for dehydration, depression, and anxiety . After a year of anxiety-driven sickness, Dr. Fernandez 's condition worsened after traveling 10 hours to Winter Haven, and being denied the chance to see his wife.

Dr. Fernandez's family who had been caring for Dr. Fernandez and his wife Clara had never heard of elder Abuse before and started calling local police agencies and the Florida Division of Children and Families, (DCF) which according to Florida law, requires DCF to make a reasonable attempt to keep families together, unfortunately visits by adult-protective care workers during 2004, in Winter Haven , Florida failed to prevent Clara's over medication and subsequent falls and incapacitation.

The unwillingness of the authorities to enforce Florida Statue 415.102 and defines "Exploitation" means a person who stands in a position of trust and confidence with a disabled adult or elderly person, and knowingly, by deception or intimidation, obtains or uses, or endeavors to obtain or use the funds, assets, or property of the elderly or disabled person for the benefit of someone other than the victim.
This led his family to start ElderAbuseHelp.Com and ElderAbuseHelp.Org in the hope that other elders, their families, or perhaps yourself, can be spared the incredible suffering and devastation of elder abuse.

It has been very costly for Clara Fernandez to get back to back to Key West, where she wanted to be , near her friends, family and husband. Clara is still suffering from the legal trauma in progress, with the legal delays .

During the time that Clara was in Winter Haven, Florida Clara was heavily over medicated and forced to turn over all the assets that her attorneys had set up in her 'Trust ' to take care of her and her husband during their old age.

There is No Police Elder Abuse Unit or Prosecutors that specialize in elder abuse to turn to for help in Florida , as in other states and Clara's expenses continue to climb.

Dr. Fernandez and Clara's case as reported to the authorities is not being prosecuted because police and prosecuting attorneys historically have view them as civil matters, and according to CAtherine c McNamee of the National Institute of Justice, "Police officers are rarely trained to investigate elder abuse and thus may not know how to interview an older adult, work with a person who has dementia, collect forensic evidence, or recommend that criminal charges be brought when responding to reports".

"The way that society doesn't value these people is reflected in how we have been investigating and prosecuting these cases," said Deputy Prosecutor Page Ulrey.

The Fernandez's family believes fighting through the pain is worth the heartbreak if other elderly people can be warned about scam artists hounding society's most vulnerable citizens.

Mail Stop to Dr. Fernandez by third parties cause serious interruptions and lapses in insurance coverage


After Dr. Fernandez and Clara stopped getting their mail for several months causing several of their insurance policies to lapse, utilities interruption, ect.

rAccording to the Identity Theft Resource Center, there are 4 types of ID theft: Financial ID Theft , Criminal ID Theft , Identity Cloning , Business or Commercial Identity Theft

In Tallahassee, a home health aide employed at an assisted living facility stole the identity of an 89-year-old resident...and diverted the woman's mail

The case was investigated by the Attorney General's Medicaid Fraud Control Unit. The suspect was charged with exploitation of the elderly, criminal use of personal identification, forgery and grand theft.

The few existing programs on elder ID theft have focused on educating people about ways to protect their identifying information.But is it realistic to assume that frail elders can and will do so?
